BROWN, DISTRICT 3 ) A Resolution Declaring IDterlm. ) Provisions and D1rect:ing the ) Jefferson COunty Planning ) CommiASion to Review and Make ) Recommenda1:ions Concerning the ) Jefferson COunty Subdivision ) Ordi~e. ) RESOLUTION NO. 51-90 WHEREAS, the subdivision of parcels five (5) acres (1/128 of a section) in size or larger are exempt from the platting requirements and standards of Jefferson County Ordinance 1-75 (Subsection 3.40.8 and 3.40.9), the Subdivision Ordinance; and WHEREAS, Jefferson County is experiencing an accelerated rate of population growth such that an emergency exists; and 'WHEREAS, said emergency entails uncontrolled growth resulting in large acreages of property being subdivided into parcels of five (5) acres (1/128 of a section) or larger for the purpose of development; and WHEREAS, the creation of said parcels is wasteful of the land resource, may result in the transfer of the private costs for improvements onto the public sector, is exempt from the environmental review process, and adds to the sprawl of development inconsistent with the policy direction stipulated in the Jefferson County Comprehensive Plan; and WHEREAS, Jefferson County has begun a process to address this growth through revision of Ordinance 1-75 to address the lack of standards concerning said large acreage parcels and to provide incentives to develop at greater densities; and WHEREAS, the Jefferson County Subdivision Roundtable was constituted to address these issues and has made recommendations to update Ordinance 1-75; and vOt Page 1 of 3 Revised by ,Resolution 62-90 May 29, 1990 16 r~r~ O(f~: 32~ A \, 100% Recycled Paper " , , WHEREAS, said Ordinance revision will take time to be drafted, reviewed, and be approved; and WHEREAS, in the intervening period additional acreages may be subdivided into five (5) acre tracts or larger compounding the problems created by this exemption; and WHEREAS, following public hearing by the Board of County Commissioners it appears to be in the best interest of the citizens of Jefferson County to benefit from interim provisions and a revised ordinance before additional parcels are created via these exemptions. NOW THEREFORE BE IT RESOLVED that interim provisions to govern the creation of acreage parcels prior to ordinance revisions are hereby declared on the use of Subsections 3.40.8 and 3,40.9 of the Jefferson County Subdivision Ordinance, and no parcel shall be created utilizing these exemption provisions except as provided for in the interim provisiol1$; and BE IT FURTHER RESOLVED that Jefferson County Planning Commission is hereby directed to review these interim provisions and proposed amendments to the Jefferson County Subdivision Ordinance and make recommendation to the Board of County Commissioners with 180 days from the adoption date of this resolution; and BE IT FURTHER RESOLVED, in order to equitably administer the transition to the interim provisions and proposed amendments to Ordinance 1-75, the following policy will be utilized when determining the applicability of the interim provisions. The interim provisions will not apply when the following conditions exist: 1. A survey of record was filed with the County Auditor prior to April 2, 1990; AND 2a. At least one (1) parcel within said survey was sold and segregated prior to April 2, 1990; .QB b. The Jefferson County Board of Commissioners have formally waived the application of the interim provisions after finding that substantial progress towards development of a large lot subdivisions has been undertaken and the application of the interim provisions would not be in the best interest of the citizens of Jefferson County. BE IT FURTHER RESOLVED that pending Planning Commission recommendation, the proposed amendments shall be considered as interim provisions and shall be effective as such from the date of passage of this resolution. Subsection 3.40.8 shall be amended as follows: Divisions of land into lots or tracts one thirty second (1/32nd) of a section of land or larger, or twenty (20) acres or larger if the land is not capable of description as a fraction of a section of land, PROVIDED, (a) that for purposes of computing the size of any lot under this item which borders on a street or road, the lot size shall be expanded to include that area which would be bounded by the center line of the road or street and the side lot lines running perpendicular to such center lines; (b) such divisions provide a sixty (60) foot legal access easement or right-of-way for ingress, egress, and utilities serving all tracts so divided provided said easement shall be desiqned in such a manner that a constructed road qrade will not exceed a qrade of fourteen (14) P7rcent; (d) legal access of no specific width, from a public road to the entire tract of land being divided shall be secured and be made a part of the legal description of the property; (e) land so divided shall not be resubdivided within five (5) years without approval of a final long plat, unless each and every tract within the resubdivision is also twenty (20) acres or larger. II. Subsection 3.40.9 is repealed. III. Amend Short Subdivision, Subsection 5.301.1, "Roads" to read as follows: 1 '101., 16 fM\~ 00 33::1 " Roads providing access to and/or within a short subdivision shall be constructed, ballasted, and surfaced according to the standards of the .1efferson County Public Works Department; provided, an agrèement for the continued maintenance of private roads is established and referenced on the final short plat. IV. Add new Section 7, renumber following sections accordingly: SECTION 7 LARGE LOT SUBDIVISIONS Subsections: 7.10 Applicability 7.20 Administration 7.30 Design 7.40 Required Improvements 7.50 Security 7.60 Certification 7.10 Applicability This section pertains to the division of land into parcel sizes one-one hundred and twenty-eighth of a section or five (5) acres or larger but less than one-thirty second. of a section or twenty (20) acres. 7.20 Administration 2 16 fMi~ 00 VCII.., 332 7.201 Consultation: The staff of the Planning and Building Department shall be available to perspective land subdivisions to review this or other sections of this ordinance, including early determination whether the proposed subdivision will necessitate environmental review. 7.202 Review Procedure: Persons wishing to subdivide property consistent with this section shall submit a survey, and completed certification checklist to the Planning and Building Department. 7.203 Approval: The Planning and Building Department shall certify compliance with this section within ten (10) days following submittal, provided, the certification checklist is complete and signatures of appropriate departments are attached thereto, surveys with incomplete certification checklists shall be returned to the applicant and shall not be approved for filing until said checklist is complete. 7.204 Environmental Review: Proposed subdivisions which involve Environmentally sensitive areas pursuant to Chapter 43.21c, Revised Code of Washington shall include an environmental review and threshold determination. Environmental clearance in these instances shall be completed and so indicated on the certification checklist. 7.205 Resubdivision: Lots created through the large lot subdivision may be subdivided pursuant to Section 6, Long Subdivisions, at any time or after (5) years from the date filing pursuant to Section 5, Short Subdivisions. : VOL 16 tAG~ 00 3 333 " 7.30 Design 7.301 Lots: 1. Residential densities shall conform with the Jefferson County Comprehensive Plan and any official control adopted pursuant thereto, and conform to the lot size standards and requirements of the Jefferson County Health Department and the Washington State Department of Health as provided for on-site sewage disposal systems. 2. The design, shape, size, and orientation of lots shall be appropriate to the use for which the lots are intended and the character of the area in which they are located. Lot areas in excess of minimum standards may be required for reason of sanitation, steep slopes, slide hazards, poor drainage, flood hazards or other unique conditions or features which may warrant protection of the public interest. 7.302 Roads: 1. Roads shall be designed with appropriate consideration for existing and projected roads, anticipated traffic patterns, topographic and drainage conditions, public convenience and safety, and the proposed uses of the land served. 2. Private roads shall be designed in accordance with the standards as prescribed in Attachment A, " Private Roadway Design Standards". 3. Public roads shall be designed in accordance with Jefferson ,County Roadway Design Standards as established by the Jefferson County Public Works Department. 4. The standard width of public or private right-of-ways shall be sixty 4 VOL 16 fACt 00', ,3"1'f1 u.... " (60) feet, however, this right-of-way width may be reduced to forty (40) feet upon favorable recommendation of the Public Works Department and approval of the Board of Commissioners. 5. Dead end roads shall include provisions for vehicle turn around consistent with the provisions of Attachment A for private roads or in accordance with the standards of the .Jefferson County Public Works Department for public roads. 6. Where necessary to join with existing roads, or to provide for futurè overall area circulation, roads may be required to extend to the outside boundaries of large lot subdivisions. 7. All lots shall be serviced with an internal roadway system when located adjacent to arterial and collector roads. 7.304 Easements/Leqal Access: 1. Easements for the purpose of ingress and egress, and/or utility installation and maintenance, shall be established by recording of a separate instrument or by declaration or dedication of easement, in either case the easement shall be graphically portrayed on the large lot subdivision survey and appropriately referenced. 2. Legal access (no specified width) from the nearest public road to the entire tract being divided shall be secured and portrayed on the face of the large lot subdivision survey. 7.305 Land Unsuitable for Development: Marshes, swamps, streamways, tidelands, aquifer-recharge areas, and land subject to flooding or having bad drainage, and land having steep slopes, or geological hazards and such 5 vot 16 r,~r, 00"°" 33,S other land as the Planning and Building Department, Public Works Department, or Health Department finds unsuitable for the purpose of building sites may be included in the boundaries of a large lot subdivision as community property, recreation area, or other similar open space or may be included as a part of a lot except any lot containing such unsuitable land must also contain sufficient land of suitable characteristics to meet county standards for construction of a dwelling. 7.306 Density Subdivision: Large lot subdivisions may divided into lots or tracts where the overall density of the subdivision does not exceed one unit per five acres. 7.306.1 Minimum Lot Size: The minimum size of individual lots within a large lot density subdivision shall be two (2) acres excluding roads, right-of-ways or egress/ingress easements. 7.306.2 Common Open Space: The common open space, that area not encumbered by individual lots or roads, shall be incorporated within the boundaries of the large lot subdivision. Large lot density subdivisions shall employ restrictive covenants, dedications or other means to maintain the prescribed density and common area. Said protective measures shall be referenced or incorporated on the face of the large lots subdivision survey, with the provision that the common open space cannot be further subdivided except through the long subdivision process. ,VOL 16r~lj~ 00 ' 6 3'),~,,,,' u't" 7.40 Required Improvements 7.401 1. 3. Roads: Private roads shall be constructed, ballasted, and surfaced to meet the minimum roadway standards as prescribed in Attachment A, rlprivate Roadway Design Standardsrl. Public roads shall be constructed, ballasted, and surfaced to meet the requirements of the 3efferson County Roadway Design Standards as specified by the 3efferson County Public Works Department. Road approach permit(s) for private roads that access onto a County or State rights-of-way shall be secured prior to approval of large lot subdivision. 2. 7.402 Road Maintenance Agreement: An agreement for the continued maintenance of priváte roads shall be established either by recording of a separate instrùment and referencing said instrument on the large lot subdivision surveyor by establishment of said agreement by declaration on the large lot subdivision survey. 7.403 Drainaqe/Erosion Control: All drainage shall be deposited in natural drainage ways whenever practical. Erosion control measures shall be employed as approved by the 3efferson County Public Works Department. 7.404 Sewaqe Disposal: 1. All lots with a large lot subdivision shall be approved for the "1 V(\~ 16 rM;~ 00' 33£"1 installation of an on-site sewage disposal system or connection to a community or sanitary sewage system; provided, where an alternative on-site sewage disposal system must be u~zed to satisfy sewage disposal requirements, said system approval shall be referenced on the large lot subdivision survey. 2. The requirements of Section 1.404(1) above may be waived when the large lot subdivision and each lot within said subdivision contains the following notice (conspicuous to the reader both in size and location): WARNING TO PURCHASERS THE LOTS, PARCELS, OR TRACTS CONTAINED WITHIN THIS SUBDIVISION HAVE NOT BEEN APPROVED FOR THE INSTALLATION OF AN ON-SITE SEWAGE DISPOSAL SYSTEM. IT IS UNKNOWN WHETHER THE LOTS, PARCELS, OR TRACTS CONTAINED HEREIN CAN OR WILL CONSTITUTE A BUILDING SITE. NO BUILDING PERMIT WILL BE ISSUED BY .JEFFERSON COUNTY WITHOUT FIRST SATISFYING THE SEWAGE DISPOSAL REQUIREMENTS ESTABLISHED BY THE .JEFFERSON COUNTY HEALTH DEPARTMENT. 1.405 1. Survey: The survey and preparation of every large lot subdivision shall be made by or under the supervision of a licensed land surveyor registered by the State of Washington. All surveys shall conform to standard practices and principles for 2. 8 yot 16 ¡'~r,: aö 338 land surveying, and include dimensions and lot area calculations for each lot. 3. Every lot corner shall be marked with an iron pipe or rebar having surveyor's cap and license number. 4. Surveys shall include a section tie and shall be graphically shown on the face of the large lot subdivision. 5. All large lot subdivision surveys shall be given a name. Said name shall not be a duplicate of another filed survey, subdivision, or plat. 6. All large lot subdivision surveys shall þe filed as a matter of public record with the office of the 3efferson County Auditor. 7.50 Security 7.501 Performance Security: As an alternative to the complete construction of the roadway system, the subdivider may elect to post a performance security for the roadway surfacing requirements established herein. Said security shall guarantee completion of the work within a stated period of time not to exceed one (1) year. ' . ,f '. , PUBLISH: 2 times, May 2 and 9, 1990 BILL: Jefferson County Planning and' Building Department . .f '. ) NOTICE OF PUBLIC HEARING, INTERIM PROVISIONS AMENDING ORDINANCE 1-15, THE JEFFERSON COUNTY SUBDIVISION ORDINANCE Notice is hereby given that the Jefferson County Board of Commissioners will conduct a public hearing to receive comments and testimony concerning the proposed Interim Amendments to the Jefferson County Subdivision Ordinance. The hearing will be conducted at 4:00 pm Monday, May 14, 1990 in thé commissioners chambers on the first floor of the ~ounty courthouse in Port Townsend. A copy of the e complete text of the proposed Interim Amendments ar.e available at the Jefferson County Planning and Building Department, third floor of the county courthouse (385-9140). .Below is a synopsis of the proposed Interim Amendments: .. Section 3.40, "Exemptions": Amend Subsection 3.40.8 increasing the exemption threshold from 1/128 of a section or five (5) acres or greater to 1/32 of ,a section or twenty (20) acres or greater. .....-... ~~ : Repeal Subsection:a.40.9, the five(5) ácre density exemption. Section 5, "Short Subdivisions": Amend Subsection 5.301.1, "Roads" to provide for design and construction consistent with Jefferson County Public Works Department standards, and requiring road maintenance agreements. I Add new Section 1, "Large Lot Subdivisions" 1.10 Applicability: This new section applies to the creation of parcels between five (5) and twenty (20) acres in size. .' 1.20 Administration: Provides for a ten (10) day administrative approval of a completed large lot subdivision. 1.30 Design: Establishes that lots created will conform to the density provisions of the Jefferson ,County Comprehensive Plan. Provides for right- of-way design, including width (40-60 feet), grade and turn-arounds. Establishes the option of a large lot density subdivision where the overall density is five (5) acrès or greater and where individual lots are not less than two (2) acres in size. 1.40 Required Improvements: Establishes that roads within large lot subdivisions be designed and constructed to meet the standards of the Jefferson County Public Works Department. (24 foot wide travel surface and ditching). Provides for establishment of a road maintenance agreement. Requires drainage detention, on-site sewage disposal approval, and surveys for lots created. 1.50 Certification: Establishes a procedure for certification of large lot subdivisions as to compliance with the provisions of this section. . Where necessary to join with existing roads, or to provide for future overall area circulation, roads may be required to extend to the outside boundaries of large lot subdivisions. 6. All lots shall be serviced with an internal roadway system when located adjacent to arterial and collector roads. 7.304 Easements/Legal Access: 1. Easements for the purpose of ingress and egress, and/or utility installation and maintenance, shall be established by recording of a separate instrument or by declaration or dedication of easemen4 in either case the easement shall be graphically portrayed on the large lot subdivision survey and appropriately referenced. 2. Legal access (no specified width) from the nearest public road to the entire tract being ßivided shall be secured and portrayed on the face of the large lot subdivision survey. 7.305 Unsuitable Land: Marshes, swamps, streamways, tidelands, aquifer- recharge areas, and land subject to flooding or having bad drainage, and land having steep slopes, or geological hazards and such other land as the Planning and Building Department, Public Works Department, or Health Department finds unsuitable for the purpose of building sites maybe included in the boundaries of a large lot subdivision as community property, recreation area, or other similar open space or may be included as a part of a lot except any lot containing such unsuitable land must also YPL 1~ . On u r M' -,..1 34~9 . . 411IIIII. , P ',' '.1 contain sufficient land of suitable characteristics to meet county standards for construction of a dwelling. 7.306 Density Subdivision: Large lot subdivisions may divided into lots or tracts where the overall density of the subdivision does not exceed one unit per five acres. 7.306.1 Minimum Lot Size: T:þ.e minimum size of individual lots within a large lot density subdivision shall be a minimum of two (2) acres in size, excluding roads, right-of-ways or egress/ingress easements. 7.306.2 The common open space shall be Common Open Space: incorporated within the boundaries of the large lot subdivision. Large lot density subdivisions shall employ restrictive covenants, dedications or other means to maintain the prescribed density and common area. Said provisions shall be referenced or incorporated on the face of the large lots subdivision survey. 7.40 Required Improvements 7.401 Roads: 1. Roads shall be constructed, ballasted, and surfaced to meet the minimum roadway stamdards as specified by the Jefferson County Public Works Department. (See Attachment A). 2. Road approach permit(s) for private roads that access onto a County or State rights-of-way shall be secured prior to approval of large lot subdivision. VOl r , 16 r~r,~ 00" 35'D ~";'" 7.402 Road Maintenance Agreement: An agreement for the continued maintenance of private roads shall be established either by recording of a separate instrument and referencing said instrument on the large lot subdivision surveyor by establishment of said agreement by declaration on the large lot subdivision survey. 7.403 Drainage: All drainage sh~ll be deposited in natural drainage ways whenever practical. Drainage shall not increase the peak flow discharge leaving the site from the pre-project discharge rate. 7.404 Sewage Disposal: All large lot subdivisions shall meet the requirements of the Jefferson County Health Department for on-site sewage disposal. Where an alternative on-site system must be utilized to satisfy sewage disposal requirements, said system shall be designed and approved and referenced on the large lot subdivision survey. 7.405 Survey: 1. The survey and preparation of every large lot subdivision shall be made by or under the supervision of a licensed land surveyor registered by the State of Washington. 2. All surveys shall conform to standard practices and principles for land surveying. 3. Every lot corner shall be marked with an iron pipe or rebar having surveyor's cap and license number. 4. " '.f '., 7.50 Certification 7.501 Subdivision Checklist: Each large lot subdivision shall be accompanied with a large lot subdivision checklist, which provides for certification as to compliance wi1:h the provisions with this section. Said checklist shall provide for the approval of the Jefferson County Health Department for on-site sewage disposal, Jefferson County Public Works for drainage controls and roadway construction, and the Jefferson County '.. . Planning and Building Department for environmental review, if any, compliance with this section, and overall approval.
