RESOLUTION ~ -90
WHEREAS, the Quinault Indian Nation lies, in part, within the geographical
boundary of Jefferson County; and
WHEREAS, the United States Supreme Court case of Brendale versus
Confederated Tribes of the Yakima Nation brings into question which
government has jurisdiction for the issuance of various land development
permits; and
WHEREAS, if Jefferson County has jurisdiction to regulate activities on non
Indian lands within the reservation boundaries, federal law requires
consideration of the political integrity, the economic security, and the
health and welfare of an Indian Tribe in determining the propriety of
regulation; and
WHEREAS, representatives from the Quinault Indian Tribe and Jefferson
County have met to find common ground over this jurisdictional question;
and
WHEREAS, no formal conclusion from these discussions has come forward; and
WHEREAS, the non-Indian landowners within the reservation boundaries are
asking for clarification in this matter;
NOW THEREFORE BE IT RESOLVED, that the Board of Commissioners hereby
directs the Planning Department to draft comprehensive plan language to
include all lands of the Quinault Tribal Reservation located in Jefferson
County, except Indian Trust Lands; and
BE IT FURTHER RESOLVED, that until said language is drafted and the
comprehensive plan amended, no construction or land development permit will
be issued by Jefferson County unless a similar construction or land
development permit is issued first by the Quinåult Indian Nation.
