WHEREAS, an Application for non-exclusive -Franchise has been submitted by Irtt~r~tåtê~'Jti ¡ 1
Cable, Int., a true copy of which Is attached hereto, for the purposes set out In the said application,
and
WHEREAS, hearing on the said application Was held before the Board of County
Commissioners of Jefferson County, Washfngton,on September 24, 1990, at the hour of 10:30 a.m.,
pursuánt to the provisions of RCW 36,55, after ~tlce given as required by taw, and
WHEREAS, It appears to be In the public Interest to grant the saldnon-exclusive frattchl$e
request, basfK,f on the following flncUngs of fact and conclusions:
1} The proposal Is not In confUct with the Jefferson County Comprehensive Plan;
2) Provision has been made by naming Jefferson County 8$ co-insured In a liability
Insurance poUcy with the Travelers Insurance to insure malntènance and repair of the
county roðd system as it relates to construction and operatIon of the p$þle system;
3) The pr~1 will serve Jefferson County consumers In rural areas not currently having,
cable television service;
4) The proposal is reflecteçl In tH& apØUcatJon filed by Interstate Cable, Inc.. on August
15, 1990" which is incorporat~ by referènCe héreln.
NOW THEREFORE IT IS HEREBY -RESOLVED that a non-exclusive franchise be and it Is
hereby gF8n~ed to the applicant named above (GRANTEE) for a period of twenty-fIve (25) years from
the date of this Resolution, to construct, operate and I11$intaln a cable television service, authorized
under Title 56 RCW, including those common under Title 56 and 57 per 56.20.015, consisting of
Instalfatlon and service connections upon, under, over, across and along the rights of way of the
county roads of Jefferson County, Washington, morep$ticurarly described as folloWS:
Those county roads lying Eàst of the Oiymplc National Forest's West boundary, and outside
the City limits of the City of Port Townsend,
This non-exc'uslve franchise is granted upon the following exprèSS terms and conditions:
(1) The said GRANTEE, Its successors and assigns, shall have the right to enter only upon
the above-described rights of way fQr :the purpose of constructing its facilities and for operating,
maintaining, repairing and using those facilities.
(2) The terms and conditions of Jefferson County Ordinance No, 2..a1, an ordinance
prescribing terms and condlttQos for franchise agreeMents granted bV 4efferson County, are
Incorporated herein by reference and made a part of this ResolutJOtt. The GRANTEE, for itself, its
successors and/or assigns. expréSSly agrees that It will strictly comply with the requirements of thè
said ordinance and any amendments theretQ. The GRANTEE undef'$tal1ds and acknowledges that the
ordinance requlr~ it to Qbtaln f1 per~t from the County Engineer before doing work under this ho","
exclusive franchise and performing oth'eraction$ relating to the franchlsedrnatter.

(3) The GRANTEE shall submit a facility plan to the County Planning Department for review
'Øf all new proposed facilities exclusive of all service connections and appurtenances. Construction
permits will be granted upon the determination that the facility plan compiles wIth the county
comprehensIVe plan. '
(4) The GRANTEE shall commence construction work under this non-excluslVe franchlseoniy
aftCiH' the· effective date hereof" $1dafter first securing necessary approvals and permits from the
County Planning Department and the Department of Public Works.
(5) The full acc,ptan~,of thl$ non-excluslve franchise and aU its terms-and conditions within
thirty (30) days from this date, by the GRANTEE, In writing, 1$ to be flied with thé Clerk of the Board
of County Commissioners of Jefferson County and shan be a condition precedant to Its taking effect,
and unless th o..exctuslve franchise Is accepted within such tim, this grant shall be nuli and voJd.

I hereby accept the terms and conditions specified under Ordinance No. 2-81, for a Non-
exclusive Franchi. granted to Interstate Cable, Inc,. for construotion, operation and maintenance of
a cable television service along and across the county roads rights of way described In Resolution
No.100-90 . approved by the Board of Jefferson County Commissioners on the 1st of October,
1990.
