RESIDENTIAL SETBACK-LINE FOR LOT 1731 KALA POINT,' DIVISION #WFFB9,�,; TY A -1)j�� WHEREAS, Kala Point Division #3 was 'platted establishing fgBee4tKV for home construction away from the bluffs edge; and WHEREAS, Kala Heights, a condominium development, was established with a similar residential setback; and WHEREAS, the Kala Heights setback was established after a detailed geologic study which indicates the bluff can support structures to within fifty (50) feet of the bluff edge; and WHEREAS, when Kala Point Division #3 was platted a detailed geologic study was not performed, and therefore the plat contained,, a greater setback than that which was established for Kala Heights;. and WHEREAS, a detailed geologic study has been performed on Lot 173, Division 3, Kala Point, finding it similar in geologic structure to' the Kala Heights area; and WHEREAS, both properties adjacent to Lot 173 are built upon to their respective residential setback lines; and WHEREAS, if Lot 173 were required to build at the setback originally established for Kala Point, the view from the lot would be substantially impaired, NOW THEREFORE BE IT RESOLVED, the setback for Lot 173 be re- established as depicted on Appendix A, providing a transition between the Kala Heights setback and the Kala Point, Division #3 setback. BE IT FURTHER RESOLVED, that this resolution be filed with the Jefferson County Auditor and referenced on the final plat mylar of Kala Point Division #3. APPROVED ANAI ADOPTED this day of 1989.
