RESOLOTION NO. 88-89 IN THE MATTER OF DELAY OF COLLECTION OF NEW MOBILE HOME ASSESSMENT ~S, the 1989 WASHINGTON STATE LEGISLATURE, IN ENGROSSED SUBSTITUTE HOOSE BILL #2136, has adopted a new program for monetary assistance to those mobile home tenants forced to relocate from mobile home parks which are closed or converted to another use; and ~S, said new law requires the County Treasurer to obtain the name and address of each mobile home owner in a mobile home park in his or her county and provide all the administrative work to collect said annual assessment; and WHEREAS, the new state law provides only a $.55 to counties for all of the administrative service in collecting each $11.00 assessment which is inadequate compensation to the County for collection of this new assessment; and WHEREAS, implementation of said new assessment collection admini~tration by the Jefferson County Treasurer will cause undue hardship upon the Jefferson County Treasurer as well as undue hardship upon the Jefferson County financial resources to support this new state assessment collection program; and WHEREAS, R.C.W. 43,135.060 states that lithe legislature shall not impose responsibility for new programs or increased levels of service under existing programs on any taxing district unless the districts are reimbursed for the costs thereof by the State"; NOW THEREFORE, BE IT RESOLVED that the Jefferson County Commissioners support the policy adopted by the Washington Association of County Treasurers and the Jefferson County Treasurer in their decision to withhold collection of this assessment until the State fully compensates the County for all administrative costs. Mikkelsen, 3efferson County Treasurer~ FROM: DATE: September 25, 1989 SUBJECT: Mobile Home Relocation Act Last spring, the State Legislature passed a bill calling for an $11.00 fee on all mobile homes in the state on leased or rented property. The law creates a fund to assist people displaced from mobile home parks due to development. This fund would go to assist those people, so displaced, to relocate. This law defines a mobile home park as any parcel of land that has two or more mobiles and generates rental income from the use of the land. The collection process was given to the county treasurers. They would get to keep $.55 per collection to cover the cost of assessment, billing and collecting. As the law is written, there are a lot of questions left unanswered. It does not address senior citizens who may have a 100% exemption and yet they would have to pay. The cost of researching county assessor records, making visits on site, postage, computer programming, supplies and constantly updating the rolls after they are developed would be prohibitive for the amount collected. I estimate start-up costs to be about $20.00 or more per unit. Estimated annual maintenance costs would be around $2.30 per unit. I feel these are very conservative estimates. The problem is largely confined to the corridor area of the three big counties - King, Pierce and Snohomish. Yet people in all counties are being made to pay the cost. This is very unfair. I sent a letter to Governor Gardner expressing my concerns before he signed the bill. Unfortunately, the developers and mobile home park owners carried more votes than the county treasurers across the state. The Governor did ask the Director of the Department of Community Development to prepare a report with recommendations for changes in the law to his office. I also wrote to our legislators expressing my concerns and offering some alternatives. They have not yet replied. At the legislative committee meeting of the Washington Association of County Treasurers held in Lake Chelan this month, a resolution was adopted. The WACT gave their support to the individual members in their decision to withhold collection of this assessment until the State fully compensates the County for all administrative costs. They based their support on Initiative 62, which passed by the voters in 1979. That initiative prohibits the Legislature from requir ing local governments to offer new or expanded services unless the cost of the new programs is paid for by the State. DCD has been given the Resolution adopted by twenty- eight of the twenty-nine counties represented. Only King County abstained. They were also presented with a list of alternatives and concerns the treasurers share., Since it is the law and we are elected to uphold the law, if nothing changes, I will be forced in 1991 to collect two years at one time and then go to annual billings. I am hoping some of the citizenry will begin to pressure our legislators to address the problem this session. I am asking that you, as the 3efferson County Board of Commissioners, sign the resolution I have written, supporting my policy to withhold collection of this assessment in 3efferson County until the State fully compensates the County, for all administrative costs. Six months full-time or 910 hours @ $5.00 per hr. + benefits $5,915.00 2. One car for six months for the above activity (Depreciation, repairs, gas, etc.) Change to tax statements to accommodate bil¡ing and software for computer programming 1,000.00 3. 500.00 Estimated start-up costs to implement collection of the $11.00 $7,415.00 We have 315 units identified and estimate there are probably at least another 35 units. Start-up costs per unit -- 350 units $ 21. 00 Breakdown of Maintenance Costs One person within the office to spend an equivalent of two weeks full time during the year to update the roll and follow-up for non-payment of ~he tax. $ 830.00 Estimated annual maintenance costs of the $11.00 fee.
