DATE: April 8, 2004 SUBJECT: Engineer's Report on request to vacate a portion of alley in Block 140, Irondale In accordance with Ch 36.87 RCW, I have examined the above referenced alley, and submit the following report. 1. The alley requested for vacation was dedicated in the plat of Iron dale and recorded on December 12, 1910, and therefore is not statutorily vacated. The request is to vacate that portion of the alley lying between lots 1 thru 8 and lots 9 - 36, Block 140. 2. The alley requested for vacation does not provide for area circulation or utilities. 3. The effectiveness of emergency services will not be impaired by this vacation. 4. The alley does not abut a body of water. 5. The proposed vacation will not land lock any parcel of property. RECOMMENDATION: Therefore, based on the foregoing Findings, the Department of Public Works recommends that the Board of County Commissioners approve this vacation request. The blocks fronting on Prospect Avenue contained 12 an alley between the lots fronting Prospect Avenue the remaining lots 13 fronting on the side streets of each block. A number of those 14 unimproved alleys have been vacated in recent years. 15 PROCEDURAL INFORMATION 16 SBPA: Categorically exempt per WAC 197-11-800(2) (h) . The petition is to vacate the alley, approximately 15' wide by 16 200' long, lying within block 140, between lots 1 thru 8, and lots 9 17 and 36, as recorded in the plat of Irondale, volume 2, page 139, 18 records of Jefferson County. 19 2. The petitioner states: "We want to build a garage within 5' of 20 the alley property line and we know tha t the alley is not needed for 21 access of any kind." 22 3. Gary Jensen, Petitioner, explained in testimony that they had 2 already placed a single family residence on their lots with space to 3 build a garage set back 5-feet from their north property line (the 4 alley r/w). When they applied for a building permit for the garage, 5 they learned that the required setback is now 20-feet from the alley. 6 Vacating the alley would reduce the required setback to 5-feet. The 7 Petitioner would also gain 7.5 feet (one half the alley width), in 8 which case the property line would then be at the center line of the 9 vacated alley. 10 5. Gary Jensen testified that he had talked with James Chase, the 11 owner of the lots on the north side of the alley. Mr. Chase supported 12 the vacation petition. 13 6. Gary Jensen testified that he had reviewed the appraisal by Ralph 14 Ericksen and had no objections. 15 16 REVIEW CRITERIA 17 Right-of-way vacation petitions are subject to JCC Chapter 12.10, Road 18 Vacations, and in particular the review criteria of JCC 12.10.130. 19 20 CONCLUSIONS OF LAW 21 1. The County Engineer responded with the following conclusions 23 after his investigation and recommends approval of the vacation: 1. The alley requested for vacation was dedicated in the plat of Irondale and recorded on December 12, 1910, and therefore is not statutorily vacated. 2. The alley requested for vacation does not provide for area circulation or utilities. 3. The effectiveness of emergency services will not be impaired by this vacation. 22 24 25 26 27 4. The vacation will allow better use of the lot. This criterion is (2) Roads should not be closed, vacated, or abandoned when land uses or development plans, or occurring patterns, indicate their usefulness for area circulation. Prior to a vacation decision, an examination should be made of its probable effect on overall area circulation in the neighborhood. Single or multiple vacations should be considered a positive tool toward improving neighborhood circulation and accesses. This alley is not needed for area circulation. This criterion is (3) The effectiveness of fire, medical, law enforcement, or other emergency services should not be impaired by the closure, vacation, or abandonment of county roads. Conclusions and Recommendation 1 (6) In compliance with RCW 36.87.130, no county road or part thereof should be vacated that abuts on a body of salt or fresh water, unless the vacation is to enable any public authority to acquire the vacated property for port purposes, boat moorage, or launching sites or for park, viewpoint, recreational, educational, or other public purposes, or unless the property is zoned for industrial purposes. 2 3 4 5 8.
