HomeMy WebLinkAbout052 04 . ;Z CìÎì9 111)2 cC: 1~ ) lojJijði STATE OF WASHINGTON County of Jefferson In The Matter of Designating } Persons with Authority to } Sign Documents for Conservation} Futures Fund Projects } RESOLUTION NO. 52-04 WHEREAS, Ordinance No. 06-0708-02 approved by the Board of County Commissioners on July 8, 2002 established the Conservation Futures Fund (or "CFF") and the Conservation Futures Citizen Oversight Committee; and, WHEREAS, the Conservation Futures Oversight Committee's annual funding recommendation for the 2004 application period was approved by the Board of Commissioners on June 28, 2004 including $26,875 for the Highway 20 Corridor Buffer project and $80,000 for the Quimper Wildlife Corridor project; and, WHEREAS, while it is the Board of County Commissioners that have the authority to bind the County in any contract or purchase where County funds will be exchanged for items of value such as real or personal property, they are also empowered to grant to their employees, agents or representatives authority to execute (sign) closing documents that might be required by third-parties (such as title companies) in order to implement and complete such contracts or purchases. PAPRITZ, a single man ("Seller"), and JEFFERSON COUNTY, a political subdivision of the State of Washington ("Buyer"), for purchase and sale of certain real property situated in Jefferson County, Washington. The Property is also known as Assessor's Parcel No. 999006801 and 999006901. The Seller and Buyer consent and agree to amend the Purchase and Sale Agreement ("the Agreement") as follows: 1. Paragraph 7.1 of the Agreement is amended by the deletion of the phrase "no later than October 20, 2004," and the insertion of the phrase "on or about October 22, 2004 but, should it be necessary, no later than November 2,2004." 2. Papritz Print name here , /h~/II / /7 I Date BUYER: Jefferson County By Chair of the County Commission iÓ/II/ÓtJ Dáte / JEFFERSON COUNTY BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST TO: FROM: DATE: SUBJECT: Board of Commissioners David Alvarez, Chief Civil DP A October 5, 2004 Real Estate Purchases using Conservation Futures Fund money Papritz to Jefferson County, Parcel #999006801 and 999006901 STATEMENT OF ISSUE: The County is about to use Conservation Futures Fund ("CFF'') money to purchase real property located in the Quimper Wildlife Corridor, specifically in the Tibbal's Lake region. The Seller is a Mr. Papritz. Previously, the County Commission (on October 4) approved the signing of a "Purchase and Sale Agreement" between the County and Mr. Papritz. It was originally expected that closing would occur on this transaction on October 20. However, because of the vacation schedules ofDPA David Alvarez and Tami Pokorny of Environmental Health, the person handling this and other CFF-funded purchases, an amendment to the "Purchase and Sale Agreement" is necessary to extend the possible closing date. The Amendment, if authorized, would suggest a closing date of October 22 but allow for closing to occur on any date through and including November 2, should other problems, not now foreseen, arise. SeTJaratelv. the County Commission is also asked to adopt on October 11,2004 a Resolution that would allow Ms. Pokorny or Mr. Alvarez to sign at the closing any documents that the closing agent (Jefferson Title) might require. This Resolution would provide continuous authorization to Ms. Pokorny and Mr. Alvarez to act on the County's behalf at any closing where the County is using CFF money to purchase real property. This Resolution should be reviewed and re-adopted for each CFF cycle, since the County Commission approves each year a new set of real estate purchases that are to be funded with CFF money. ANALYSIS: This Contract Amendment allows the County to go ahead and preserve open space. FISCAL IMPACT: No impact on the general fund. This is a request that the Board sign a Contract Amendment. The purchase will be made with CFF money. The CFF was established (pursuant to Ch. 84.34 RCW) by County Ordinance #06-0708-02 and is a dedicated source of money intended to allow the County to buy real property and preserve it in its natural (or undeveloped) condition.
