A number of the alleys have been vacated in recent years as 12 individual lots are developed. 13 PROCEDURAL INFORMATION 14 SEPA: Categorically exempt per WAC 197-11-800 (2) (h) . Notices: Mailed: September 16, 2004 Posted: September 16, 2004 15 16 17 Publication: September 22 and 29, 2004 18 Site Visit: October 5, 2004. 19 Hearing Date: October 5, 2004 20 TESTIMONY: 21 The public hearing was opened on October 5, 2004, at 1:00 p.m. in the 22 Courthouse First Floor Conference Room. After the procedures for the 23 public hearing were explained, testimony was accepted. All testimony 24 was taken under oath. The petition is to vacate all of the platted alley in Block 145 14 of Irondale No 6, approximately 12'x200'. 15 2. The principal petitioner is is David Tonkin. 16 3. The petitioner states: "Our new manufactured home must be installed length-wise north to 17 south because of the design of the septic system (SEP02-00225). The door from the utility room that would enter the garage is at 18 the south end of the parcel, there is no room for the garage. If the alley is vacated, we will gain 6 feet of property and reduce 19 the setback to 5 feet. This will provide room for the garage.H 20 4. Road vacations are exempt from SEPA, per WAC 197-11-800 (2) (h) . 21 5. The appraisal of $1,400.00 would result in a cost to the 2 petitioner of $700.00 (50% of the appraised value). The Petitioner 3 testified that he had reviewed the appraisal by Ralph Ericksen and had 4 no obj ection. 5 8. The County Engineer responded with the following after his 6 investigation: 7 a. Irondale No 6 was recorded on June 28, 1910, and therefore 8 is not statutorily vacated under RCW 36.87.090. 9 b. The alley does not provide area circulation or utilities. 10 c. Emergency services will not be impaired. 11 d. The alley does not abut a body of water. 12 e. The proposed vacation will not land lock ,any parcel. 13 f. The licensed appraiser indicates a value of $1,400.00. 14 REVIEW CRITERIA 15 Right-of-way vacation petitions are subject to JCC Chapter 12.10, Road 16 Vacations, and in particular the review criteria of JCC 12.10.130. 17 CONCLUSIONS OF LAW 18 The following conclusions may contain additional Findings of 19 Fact: 20 1. The Hearing Examiner is duly appointed by the Jefferson County 21 Board of Commissioners to hear petitions for right-of-way vacations 22 and make recommendation to the Board. 23 2. A review of the proposal's compliance with the seven criteria 24 specified by JCC 12.10.110 follows: 25 (1) The proposed road vacation complies with the Jefferson County comprehensive plan and any other applicable plans, policies, or ordinances. 26 27 3. Since the plat is designated/zoned Rural Residential 1:5 and 28 surrounding properties are in'different ownerships, the proposed 29 residential use is appropriate. This criterion is met. David Tonkin, Petitioner Irondale # 6 Blk 145 Alley Page 3 Findings, Conclusions and Recomrnendation 1 (2) Roads should not be closed, vacated, or abandoned when land uses or development plans, or occurring patterns, indicate their usefulness for area circulation. Prior to a vacation decision, an examination should be made of its probable effect on overall area circulation in the neighborhood. Single or multiple vacations should be considered a positive tool toward improving neighborhood circulation and accesses. 2 3 4 5 4. The alley parallels and is only 100 feet from Prospect Avenue. 6 The alley is not needed for area circulation. This criterion is met. 7 (3) The effectiveness of fire, medical, law enforcement, or other emergency services should not be impaired by the closure, vacation, or abandonment of county roads. Appropriate authorities should be consulted with respect to this policy. 8 9 10 The appropriate authorities were notified of the petition. Their 5. 11 lack of response to this type of petition in this plat was 12 anticipated. This criterion is met. 13 (4) Roads should not be closed, vacated, or abandoned when such routes can effectively be used for utility corridors. Suitable utility easements could be retained as a means of satisfying this policy. Public and private utility companies and their plans should be consulted with respect to this policy. In compliance with RCW 36.87.140, the board of county commissioners may retain an easement within the subject vacated area for the construction, repair, and maintenance of public utilities and services. 14 lS 16 17 18 None of the applicable agencies have utilities in the alley. 6. 19 This criterion is met. 20 (5) Roads should not be closed, vacated, or abandoned when such routes can be effectively used for trails or pathways. Suitable trail easements could be retained as a means of satisfying this policy. The Jefferson County parks, recreation, and open space plan should be used as a guide to determine trail needs. 21 22 23 7. The Park Advisory Board found no need. This criterion is met. 24 (6) In compliance with RCW 36.87.130, no county road or part thereof should be vacated that abuts on a body of salt or fresh water, unless the vacation is to enable any public authority to acquire the vacated property for port purposes, boat moorage, or launching sites or for park, viewpoint, recreational, educational, or other public purposes, or unless the property is zoned for industrial purposes. 2S 26 27 28 8. The alley does not abut a body of water. Prospect Avenue is open on the north and Stromberg Avenue is open 3 on the east. Victory Avenue is not open on the west, but is available 4 to be opened. This criterion is met. 5 10. Fischbach, County Administrator Frank Gifford, Public Works Director 5o..J:1 DATE: October 18,2004 FROM: SUBJECT: Standard Road Vacation Request, Alley in Block 145, Irondale No.6; David Tonkin, Petitioner STATEMENT OF ISSUE: Road Vacation petition submitted by David Tonkin for all of the platted alley in Block 145, Irondale No.6. This road vacation was heard before the Jefferson County Hearing Examiner on October 5, 2004. His recommendation is enclosed. ANALYSIS/STRATEGIC GOALSIPRO'S and CON'S: The BOCC is to take into consideration the Hearing Examiner's recommendation, the County Engineer's report 8: recommendation, and any other comments that may be received from the public and/or adjoining property owners. No testimony has been received in opposition to this vacation. The final resolution is attached pending the Board's decision. FISCAL IMPACT/COST BENEFIT ANALYSIS: There is no fiscal impact as this is an un-opened and un-maintained alley that is not needed for area circulation. RECOMMENDATION: The Public Works Department and the Hearing Examiner recommend approval of the request and the signing of the attached resolution.
