HomeMy WebLinkAbout063 04CC,. f ;Ikil&10� 1 (6!x3)) STATE OF WASHINGTON County of Jefferson IN THE MATTER OF ADDRESSING THE DECEMBER 1, 2004 GROWTH MANAGEMENT ACT COMPREHENSIVE PLAN UPDATE DEADLINE } ESTABLISHED IN RCW 36.70A.130(4) } RESOLUTION NO. 63-04 WHEREAS, the Board of Jefferson County Commissioners ("the Board") has, as required by the Growth Management Act ("GMA" or the "Act"), as codified at RCW 36.70A.010 et seq., adopted the Jefferson County Comprehensive Plan (the "Plan"), a Plan that was originally adopted by Resolution No. 72-98 on August 28, 1998 and subsequently amended; and, WHEREAS, in furtherance of the Plan, the County adopted its GMA-derived development regulations, known locally as the Unified Development Code (or "UDC"), in December 2000 to be effective as of January 16, 2001; and, WHEREAS, the Growth Management Act establishes a schedule for mandatory reviews, and if necessary, updates of local jurisdiction comprehensive plans and implementing regulations to ensure compliance with the Act; and, WHEREAS, the deadline for Jefferson County to complete this review is December 1, 2004, as established in RCW 36.70A.130(4); and, WHEREAS, this update process is distinct from and additional to the normal annual process established in Jefferson County for accepting, reviewing, debating and, ultimately, enacting changes to the County's Comprehensive Plan and UDC and as such is an additional burden on the County's limited staffing resources; and Resolution No. 63-04 re: December 1, 2004 Deadline for Growth Management Update WHEREAS, Jefferson County has completed a review of the Comprehensive Plan and UDC and proposed amendments thereto with respect to the mandatory update; and, WHEREAS, the County proposal concentrates on the allocation of project population for the 20 -year planning period ending in the year 2024, corresponding updated capital facilities and transportation planning, and the review of best available science and associated regulatory protections for GMA critical areas, known as environmentally sensitive areas in this County's UDC; and, WHEREAS, the County received voluminous comments from the State Departments of Ecology and Fish and Wildlife and the Puget Sound Action Team on the proposed regulatory protections for GMA critical areas and will require some additional time to digest and analyze those comments; and WHEREAS, the County Planning Commission has held a duly noticed public hearing and accepted written comment on the whole of the 2004 Comprehensive Plan amendment docket, components of which are these proposed Plan and UDC amendments associated with the mandatory update; and, WHEREAS, the public process associated with the Comprehensive Plan annual amendment cycle has yet to be completed; and, WHEREAS, the Board expects to hold a public hearing on the whole of the 2004 Comprehensive Plan amendment docket on December 6, 2004; and, WHEREAS, the Board anticipates legislative action on the docket, including the elements associated with the mandatory update, on or around December 13, 2004; and, Page 2 of 3 N . . Resolution No. 63-04 re: December 1, 2004 Deadline for Growth Management Update WHEREAS, the Board does not anticipate any negative consequence for pursuing this projected schedule as opposed to one that concludes prior to December 1, 2004; NOW, THEREFORE, BE IT RESOLVED as followed by the County Commissioners in and for the County of Jefferson: 1. That the County, in an effort to comply with RCW 36.70A.130(4), has reviewed and will continue to review its Comprehensive Plan and UDC and has developed proposed amendments thereto in order to update narrative, goals, policies, and regulations in order to ensure compliance with the Act; and, 2. That, the Board, acting in its legislative capacity, intends to adopt amendments to the Comprehensive Plan and UDC as soon as practicable, with an anticipated ordinance adoption date of December 13, 2004, the second regularly scheduled day of public business conducted by it in December and the Board anticipates no substantial negative consequence for failing to take legislative action on said proposals prior to the statutory deadline of December 1, 2004.
