Declaration of Emergency

RESOLUTION NO. 76-04
WHEREAS, The County Director of Emergency Management reported that
beginning November 24,2004 heavy precipitation in West Jefferson County resulted in
high runoff and flooding on local rivers and streams, and,
WHEREAS, The Jefferson County Department of Public Works determined that
the runoff and subsequent related weather events resulted in substantial erosion damage
to the Barlow Bridge (at Fossil Creek) on Oil City Road (134309) at MP 9.75, and,
WHEREAS, channel scour from further runoff and rainy conditions in the near-
tenn wi11likely worsen the integrity of the already damaged county facilities; and,
WHEREAS, persons and property are, or may be, damaged unless further efforts
are taken to reduce the threat to life and property; and,
WHEREAS, there is an emergency which necessitates activation of the Jefferson
County Comprehensive Emergency Management Plan, and may require utilization of
emergency powers granted pursuant to RCW 38.52.180 in order to effectively respond to
the emergency needs of the community.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Jefferson County
Commissioners hereby declare that a state of emergency exists.
The County Director of Emergency Management is hereby directed to activate
those portions of the Jefferson County Comprehensive Emergency Management Plan as
are reasonable and necessary to combat the effects of the emergency.
The County Department of Public Works is authorized to enter into contracts and
incur obligations necessary to combat this emergency to protect the health and safety of
persons and property, and provide emergency assistance to victims of disaster.
The County Department of Public Works is authorized to exercise these
emergency powers in the light of the exigencies of an emergency situation without regard
to time consuming procedures and fonnalities prescribed by law, with the exception of
mandatory constitutional requirements.
