Clarify the term "Play
Ground" on Lot 34 of Melwood
Terrace Subdivision
WHEREAS, the Jefferson County Board of Commissioners and
applicable County Departments have approved the Melwood Terrace
Subdivision, and
WHEREAS, the Melwood Terrace Subdivision was recorded
with the Jefferson County Auditor on October 15, 1974 under AFN
225396, Page 100-101, Volume 5 of Plats, and
WHEREAS, the Planning Department records have been
researched and found that no record of the public review of the
Melwood Terrace Subdivision exists, except for filed mylar and that
this Subdivision pre-dates the existence of the Planning
Department, and
j WHEREAS, Restrictive covenants pertaining to the Melwood
Terrace Subdivision were recorded with the Jefferson County Auditor
on October 15, 1974 under AFN 225397, Page 185-187, Volume 55 of
Deeds, and
WHEREAS, it is the request of the property owner of Lot
34, Melwood Terrace to clarify "Play Ground" as depicted on the
face of the plat, and
WHEREAS, the term "Play Ground" is not dedicated as "open
space" or referred to in any manner in the Restrictive Covenants
or Dedication on the face of the plat,
NOW THEREFORE BE IT RESOLVED that upon approval of this resolution,
Lot 34 of Melwood Terrace Subdivision may be utilized as a
residential building site provided said site meets environmental
health, building location standards established in County codes,
and
BE IT FURTHER RESOLVED that this Resolution shall be filed with the
county Auditor and said "Play Ground" notation contained on Lot 34
of the filed plat shall be stricken, referencing this resolution
by its number.

Dwelling Size - Bo dwelling shall contain less than
1000 square ~..et of floor area on the ground ~loor,
excluive ot open porches and garages.
Structure Height - No structure shall exceed a height
ot 18 ~eet ~rom the ground line 1 except on Lots 1, 22,
23, 24, 25, 26 and 27. On lots 1,22,23, 24, 25, 26
and 27 DO structure shall have IIIOre than two (2)
stories above ground and no structure shall exceed a
height of 32 feet from the ground line.

12'. Covenants 'rhese Covenants are to run with the land and
llhall be binding On all parties having an interest in any
tot in MelWOOd Terrace from the date these covenants are
recorded. 'rhese covenants shall be binding on all partie.
for a period of 25 years from the date of recording and
ahall continue in effect thereafter, being automatically
extended for successive periods of ten (10) years unless
an instrument signed by a major! ty of the then owners of
the Iota has been ,filed for record agreeing to change
aaid covenants in whole or part. ,
13. severability - Invalidation of anyone of these covenant8
by judgment or court order shall in no way affect any of
the other provisions which shall remain in full force and
