WHEREAS, Jefferson County has been declared a Critical Water Supply Service Area through County Resolutions 97-83 and 118-83 in 1983 and under the provisions of Chapter 70,116 RCW (Public Water System Coordination Act of 1977). WHEREAS, the County has appointed a Water Utility Coordinating Committee (WUCC) to oversee the development and implementation of the CWSP. WHEREAS, a Coordinated Water System Plan (CWSP) was developed and approved by the Department of Health (DOH) in 1986 according to Chapter 70.116 RCW and Chapter 246-293 WAC (Water System Coordination Act implementing regulations), and must be updated every five years. WHEREAS, according to WAC 246-293-210, the boundaries of the Critical Water Supply Service Area need to be reviewed every five years as part of the CWSP update, WHEREAS, review of the Critical Water Supply Service Area was an agenda item for August 30, 1995 WUCC meeting. WHEREAS, a motion of the WUCC was carried (with one dissenting vote), to keep the existing Critical Water Supply Service Area. BE IT HEREBY RESOL VED, that the Critical Water Supply Service Area boundary established in 1983 remain unaltered until further advised by the WUCC. ~ð -1/-1) APPROVED this £ day of O~, 1995. WHEREAS, the County has appointed a Water Utility Coordinating Committee (WUCC) to oversee the development and implementation of the CWSP. WHEREAS, the County has been in the process of updating the CWSP since 1989. WHEREAS, a Draft CWSP was prepared in 1992, but was not submitted to the Department of Health for adoption because of concern over the level of public involvement. WHEREAS, under the most recent update efforts, beginning in 1994, the City of Port Townsend has expressed the desire that SEPA (Chapter 43.21 C RCW) compliance for the CWSP be met with a full Environmental Impact Statement (EIS). WHEREAS, the County agreed at a meeting February 21, 1995 with the City of Port Townsend .and the PUD to pursue development of an EIS on the project. WHEREAS, the County issued a Declaration of Significance on November 16, 1994, and held a Scoping Meeting on November 23, 1994. WHEREAS, only two written responses were received as a result of the scoping announcement, and !b.ese were consistent with the verbal comments from the scoping meeting. Such comments indicated the impacts were the result of the County's Comprehensive Plan and not the CWSP, and that the CWSP is a plan to implement public water system development, expansion, and upgrade in response to growth under the County's Comprehensive Plan. WHEREAS, County staff have advised the WUCC that the cost of an EIS will be Page 1 of 2 WUCCORD4.DOC VOL 21 'Ar.; -' r~ . O.1.16t;. approximately $45,000 and take approximately four months to complete. WHEREAS, no other county has produced an EIS on a CWSP. WHEREAS, there has been continual discussion among WUCC members, since this subject was raised by the City of Port Townsend in 1994, regarding the need for an EIS on the CWSP. WHEREAS, the need for an EIS was on the WUCC agenda and discussed August 3D, 1995 and the WUCC unanimously adopted a motion to request that the County Commissioners secure a legal opinion regarding the need for an EIS on the CWSP and that request for same be tendered in written form and executed by the members of the Jefferson County Board of Commissioners. --------------------------------------------------------------------------------------------. BE IT HEREBY RESOLVED, that the Water Utility Coordinating Committee (WUCC) requests the Board of County Commissioners to secure a legal opinion of whether a separate EIS is necessary for the CWSP or, if required, whether it can be consolidated with the EIS developed for the County's Comprehensive Plan.
