Fischbach Clerk of the Board: Lorna Delaney MINUTES Week of July 11, 2005 Chairman Phil Johnson called the meeting to order in the presence of Commissioner David W. Sullivan and Commissioner Patrick M. Rodgers. PUBLIC COMMENT PERIOD: The following comments were made: several people commented about the past use ofW. Nolton Road on Marrowstone Island, the vacation of the road, and how it affects their access to the tidelands; residents who live in Port Townsend are obstructing economic development in other communities in the County that want growth and development; comments were made about the current Executive Board of the Economic Development Council and the future of the organization; when the Board begins to work on the 2006 Budget, they will find that there is limited revenue for discretionary items; Jefferson County has six items on Washington State's unclaimed property list; complaints were made about the County not maintaining the property at Castle Hill Mall; water is the key to reasonable and sensible development in the County; and concerns were expressed from Marrowstone Island residents about some of the suggested provisions of the draft WRIA 17 (Water Resource Inventory Area) document. APPROVAL AND ADOPTION OF THE CONSENT AGENDA: Commissioner Rodgers moved to approve the Consent Agenda as presented. Commissioner Sullivan seconded the motion which carried by a unanimous vote. 1. HEARING: Authorization To Increase the Current $10 Surcharge on Superior Court Cases Filed Under Title 26 RCW (Excluding RCW 26.50 Et Seq), and Add New Fees for the Courthouse Facilitator Program: Chairman Johnson opened the public hearing. Superior Court Clerk Ruth Gordon stated that the State recently passed legislation that allows a $10 increase in the current surcharge on filings of certain domestic cases. This surcharge would be used to increase the subsidy for the Courthouse Facilitator Program. Although the Courthouse Facilitator Program is not mandated, it has been very successful in helping defray the County's expense for people seeking divorces without legal council because the Facilitator helps process the paperwork which saves time in the Courtroom Commissioner Rodgers asked if filing fees cover the cost of processing? Ruth Gordon explained that in the case of a civil suit, the filing fee is $200. The County receives $91 and the Law Library receives $17. The remainder goes to the State's Public Safety and Education Accounts and a portion of it may come back to the County for specific uses but it doesn't go into the General Fund. The Chair opened the public testimony portion of the hearing. Hearing no comments for or against the increase in the surcharge, Chairman Johnson closed the public hearing. Commissioner Rodgers moved to approve ORDINANCE NO. 07-0711-05, authorizing an increase to the current $10 surcharge on Superior Court Cases Filed Under Title 26 RCW (Excluding RCW 26.50 Et Seq), and adding new fees for the Courthouse Facilitator Program. Commissioner Sullivan seconded the motion which carried by a unanimous vote. BIDDER Concrete Technologies Corporation, Tacoma AMOUNT $69,746.24 The Engineer's estimate is $39,096.00. Commissioner Sullivan moved to have Public Works staff review the bid for accuracy and make a recommendation for bid award that is to the best advantage of the County. Commissioner Rodgers seconded the motion which carried by a unanimous vote. The Board met in Executive Session from 10:45 to 11: 15 a.m. with the County Administrator and Deputy Prosecuting Attorney regarding actual litigation; and from 11: 15 to 11 :30 a.m. with the County Administrator, Deputy Prosecuting Attorney, and the Public Health Director regarding potential litigation. The meeting was recessed at the close of business on Monday and reconvened on Tuesday at 9:30 a.m. All three Commissioners were present.
