submitted by the Jefferson County Public Utility District No. I, a
true copy of which is attached hereto, for the purposes set out in the
said Application, and
WHEREAS, hearing on the said Application was held before
Board of County C~issioners of Jefferson County, Washington,

RCW 36.55, after notice given as required by law, and

said non-exclusive franchise request, NOW, THEREFORE,
IT IS HEREBY RESOLVED that a non-exclusive franchise be and it is
hereby granted to the applicant named above (GRANTEE) for a period of
twenty-five (25) years from the date of this Resolution, to install,
operate, maintain, repair and use watermain facilities consisting of
pipes, valves, fire hydrants, etc., in, under, along and across that
portion of county road rights-of-way described as follows:
The West half of the West half of Section 33, Township 31 North,
Range I West, W.M.; all of Sections 31 and 32, Township 31 North,
Range I West, W.M., and the West half of the West half of Section 4,
Township 30 North, Range I West, W.m.; all of Sections 5, 6, 7, 30,
31, and 32, Township 30 North, Range I West, W.M.; al I of Sections
1,12, 13, 23, 24, and 25, Township 30 North, Range 2 West, W.M.;
The South half of Section 19, Township 30 North, Range I West,
W.M. ;
The South Half of Section 29, Township 30 North, Range
W.M. and the West half of Section 33, Township 30 No., Range
W.M.

This non-exclusive franchise is granted upon the following
express terms and conditions:
(I) The said GRANTEE, its successors and assigns, shall have the
right to enter only upon the above-described rights of way for the
purpose of constructing its faci Ii ties and for operating, maintaining,
repairing and using those faci I ities.
(2) The terms and conditions of Jefferson County Ordinance No.
2-81, an ordinance prescribing terms and conditions for franchise
agree~nts granted by Jefferson County, are incorporated herein by
reference and made a part of this Resolution for al I purposes as fully
a s i f set for t h i nth i s Re sol uti 0 n . The rnANTEE, for its elf , its
successors and/or assigns, expressly agrees that it will strictly
comply with the requirements of the said ordinance and any amendments
thereto. GRANTEE understands and acknowledges that the ordinance
requires it to obtain a permit fr~ the County Engineer/Director of
Public Works before doing work under this non-exclusive franchise and
performing other Jctions relating to the franchised matter.

(3) The CRANTEE shall submit a facility plan to the County
Planning Department for review of all new proposed facilities exclusive
of service connections and appurtenances. Construction permits wi I I
be granted upon the determination that the foci lity plan c~plies with
the county canprehensive plan.
(4) The GRANTEE shal I crnnnence construction work under this
non-exclusive franchise only after the effective date hereof, and
after first securing necessary approvals and permits from the County
Planning Department and the Department of Public Works.
(5) The ful I acceptance of this non-exclusive franchise and all
its terms and conditions within thirty (30) days fran this date, by
the GRANTEE, i n w r i tin g, i s t 0 be f i led wit h the C I e r k 0 f the Boa r d 0 f
County Crnnnissioners of Jefferson County and shall be a condition
precedent to its taking effect, and unless the non-exclusive franchise
is accepted within such time, this grant shall be null and void.

ACCEPTANCE OF FRANCHISE TERMS AND CONDITIONS
I hereby accept the terms and conditions specified under
Ordina~ce No. 2-81, for a Non-Exclusive Franchise granted to Jefferson County'
Public Utility District NO.1, for construction, operation and maintenance
of water' lines along and across the county road right~of-ways des-
cribed in Resolution No. 28-85, approved by the Board of Jefferson County
conunissioners on the 8th day of April , 19,85 .
