Timber Counties Caucus Members,
If you haven’t already seen it, attached is the WA Supreme Court opinion we’ve been waiting for in the Conservation NW v. DNR case. This is the case challenging DNR’s interpretation
of their trust responsibility to the trust beneficiaries. The Supreme Court agreed with the Superior Court decision and affirmed their dismissal. This is a very beneficial decision
for counties as trust beneficiaries, upholding the previous finding in the Skamania County v. DNR case that established DNR’s duty of undivided loyalty to trust beneficiaries.
