HomeMy WebLinkAbout067 86 - ŒCf'n"~,:~1t-,' < / ( 00L./ ..¡ v " ., RESOLUTION NO. 67-86 ORDER BUDGET APPROPRIATION JEFFERSON COUNTY DISTRICT COURT WHEREAS, the Jefferson County Board of Commissioners did, on the 22nd day of July, 1986, declare an emergency existed to provide the sum of $2,500.00 for the District Court budget and set a hearing on said emergency for the 11th day of August, 1986, at the hour of 4:00 p.m.; and WHEREAS, this being the time and place set for said hearing and no objection or objection interposed; now, therefore, IT IS HEREBY ORDERED, by the Board of Jefferson Commissioners, that due to there being sufficient funds in the unencumbered fund balance of the Current Expense Fund, that the Jefferson County Auditor be, and she is hereby authorized to include the sum of $2,500.00 in the District Court budget, Fund No. 800 BARS #512.40.41.30. PORT TOWNSEND, WASHINGT~ 98368 TELEPH()NE:~l July 8, 1986 TO: Jefferson County Cocrmissioners RE: Court Appointed Attorneys Gentlemen: For the 1986 fiscal year, $1000.00 was budgeted for Court Appointed Attorneys other than the Public Defender. District Court will need a supplemental appropriation for that category. In 1985, there were six cases in which the Court was required to appoint an attorney because or the Public Defender's having a conflict of interest. Those Court appointments cost Jefferson County $744.55. As of May 30, 1986 it was necessary for the Court to make six such appointments. Of the 51000.00 budgeted, $775.00 has been spent on four of these cases. The other two cases have been disposed or but are waiting approval of attorney's fees. Meanwhile, I have assigned attorneys on July 2, 1986 to defend two more such cases. As the Public Defender's private practice grows, we can expect more such appointments. Speaking of the Public Defender, I should alert you to the fact that the County can expect to come close to doubling it's Public Defender expenditures for 1987. First, District Court has been paying Court Appointed Attorneys 535.00 per hour for their work. In view of what is considered a reasonable attorney's rate, I believe that it is inequitable for Jefferson County to require these attorneys to provide their services at $35.00 an hour. It is not incumbent upon the local attorneys to subsidize the County. w~ile the County cannot afford to pay each attorney his or her standard hourly rate, I believe that the County should pay $50.00 per hour. Secondly, the workload of the Public Defender has increased. The following is the number of cases handled by the Public Defender as or VDL 12 f~r;: o 2894 · Page 2 Cou~ty Commissioners June 30 during the years indicated: (a) 1984 - 74 cases (b) 1985 95 cases (c) 198ó - 114 cases The following reflects the total number of cases handled by the Public Defender during the ~ear indicated: (a) 1984 - 140 cases (b) 1985 - 197 cases (c) 1986 - 240 cases (estÜ¡ated) The greater demand for the services of the Public Defender is not surprising. As Olympia stiffens the penalties for crime, more people demand to cons~lt with an attorney before disposing of their case.
