ORDER OF VACATION
ALLEY OF BLOCK 19, EISENBEIS BAY VIEW ADDITION
This matter coming to be heard on the 12th day of December, 1983, upon the
Acting Public Works Director's report and the County Planning Department's
report with respect to the vacation set forth in "Petition to Vacate a
County Road" submitted by Clarence D. Bramhall, and it appearing to the
Board of County Commissioners that notice of hearing had been posted and
published for the time and in the manner provided by law, proof of such
posting and publication being now on file herein, and said Board having
the other evidence adduced, and being fully advised in the premises, does
now find and determine that the public will be benefited by the vacation
thereof; now, therefore,
BE IT RESOLVED, and it is HEREBY ORDERED THAT:
All of the 10 foot wide by 300
foot long alley in Block 19 of
the Plat of Eisenbeis Bay View
Addition as recorded in Volume
2, Page 54 of Plats, records of
Jefferson County
be, and the same is hereby vacated and abandoned pursuant to RCW 36.87.140;
and
BE IT FURTHER RESOLVED, that said petition is exempt from compen-
sation requirements specified under Ordinance No. 2-76, except for the
expenses incurred by the County for investigation, examination, publication
and recording.

NOTICE IS HEREBY GIVEN that a public hearing will be held by the Jefferson
County Board 'of Commissioners on Monday. December 12. 1983 at 11:00 a.m. in the
commissioners '.chambers at the county courthouse in Port Townsend. Washington
for the p~rpose of receiving testimony for the vacation of the following
described right-of-way:
All of the' 10 foot wide by 300 foot long alley in
Block 19 of the plat of Eisenbeis Bay View Addition
as recorded in Volume 2. Page 54 of plats. records of
Jefferson County.

The principal'petitioner shall contact the Jefferson County Public Works Department
for legal description of right-of-way to be vacated.
The principal petitioner shall submit to the Jefferson County Board of Commissioners
a complete petition, accompanied by a bond in the penal sum of one hundred dollars
($100.00) to cover county processing expenses. Checks or money orders shall be
made payable to the Jefferson County Commissioners Revolving Fund.
The principal petitioner shall include with the petition a map suitable for repro-
duction thòt is no larger than 8~ by 11 inches showing to a reasonable scale: (a)
the county road, or portion thereof, proposed to be vacated; (b) the property loca-
tion and names of all petitioners; (c) the property location an? naq¡es of an adja:",
cent property owners who did not sign the petition, with an attached. list of their
addresses; and (d) the nearest constructed county road to the proposed vacation.
(This information can be found in the Jefferson County Assessor's Office~ Jefferson
County Public Works Department~ and/or a local title company.)
The principal petitioner is requested to be present at the meetings of the Jefferson
County Planning Commission and Board of Commissioners when this petition is con-
sidered.

Acknowledgement
The principal petitioner hereby acknowledges: (a) Jefferson County may retain an
easement within the subject vacated area for the construction, repair, and maintenance
of public utilities and services, pursuant to R.C.W. 37.87.140 and Section 5 of the
Jefferson County Road Vacation Ordinance; and/or (b) Jefferson County may retain an
easement within the subject vacated area for trail or pathway purposes, pursuant to
Section 5 of the Jefferson County Road Vacation Ordinance; and/or (c) Jefferson County
may require compensation by the principal petitiûner and/or benefiting property owners
as a special condition for granting approval of the petition. pursuant to R.C.lv.
36.87.120 and Section 6 of the Jefferson County Road Vacation Ordinance.
The principal petitioner also acknowledges that he or she shall compensate the
county for any additional expenses incurred in the processing of said petition, which
may exceed the one hundred dollar ($100.00) bond. Checks or money orders for said bond
and/or expenses shall be made payable to the Jefferson County Commissioners Revolving

REQUEST
The request is to vacate the 10 foot wide by 300 foot long al ley right-
-of-way within Block 19 of the Eisenbeis Bay View Addition. The unconstructed
aJ ley is located east of State Highway 20, approximatély one mi Ie south of the
Port Townsend city I ìmits in Section 16, Township 30 North, Range 1 West, WM.
The principle petitioner requests the vacation since the al ley abuts a
vacated road On the west end and, therefo~e, has restricted access. The
principle petitioner owns al I of Block 19 and stated that the al ley can be used
more efficiently and productively for purposes other than al ley access.
FINDINGS
1. A petition for vacation of a county al ley is made pursuant to the Jefferson
County Road Vacation Ordinance and is subject to its requirements and
review criteria.
2. The proposed vacation is not within a designated trai I corridor of the
Jefferson County Park, Recreation, and Open Space Plan.
3. The optimum land use map of the Jefferson County Comprehensive Plan
designates the area of the proposed vacation as suburban and or industria!.
The goals and pol icies of the transportation/circulation section of the
plan apply to this proposa!.
4. Notice of the proposed vacation was made to the fol lowing agencies by mai I:
a. Jefferson County Publ ic Works Department: Recommends approval.
b. Puget Sound Power and Light Company: No response.
c. Pacific Northwest Bel I Telephone Company: No objection since there
are no telephone I ines in the al ley.
d. Cape George Fire District 6: No objection.
e. Jefferson County Sheriff1s Office: No response.
f. Emergency Services Counci I: No response.
g. Port Townsend Uti I ities Department: No objection since the water line
runs along Otto Street.
h. Jefferson County Assessor1s Office: The assessed value of the al ley
is $1,200.
Jefferson County Publ ic Uti I ity District 1: No response.
5. Adjacent property owners were informed of the vacation request by mai I. No
responses were received.
6. On July 26, 1982 the Jefferson County Board of Commissioners approved a
request to vacate Li I I ¡an Street in exchange for a thirty foot wide
buffer strip along State Highway 20.
7. Review of the proposed vacation by the Jefferson County Planning Commission
is scheduled for their regular monthly meeting of December 7, 1983. Notice
of the meeting was made by mai I to al I petitioners and abutting property
owners.
8. A publ ic hearing has been scheduled by the Jefferson County Board of
Commissioners for December 12, 1983 at 11:00 a.m. in their chambers at the
county courthouse in Port Townsend. Pub I ic notice of the hearing was made
by publ ishing legal notices in the November 30 and December 7, 1983
editions of the Port Townsend Leader and posting the subject site with
notices.
PLANNING COI"MISSION ACTION
At th~ir meeting on December 7, 1983, the Jefferson County Planning
Commission reviewed the vacation request and findings. Clarence Bramhal I spoke
in favor of the request. The commission discussed the assessed value of
the al ley to consider compensation for the vacation. By majority vote, the
commission recommended the board ot commissioners approve the vacation request.
One vote was cast against the motion since it did not include a measure for
compensation.

BOARD OF COMMISSIONERS ACTION
At the pub i i c hear i ng on December 12, 1983, the Jefferson County Board of
Commissioners reviewed the request, findings, and planning commission action.
Clarence 8ramhal I spoke in favor of the request. The board discussed the possi-
bi I ity of requiring compensation 'for the al ley vacation. The board co~sice~ec
requiring Mr. 8ramhal I to perform $1,200 worth of landscaping within the 30 foot
greenbelt in front of his property adjacent to State Highway 20. Mr. 8ramhal I
stated that he did not feel the al ley was worth $1,2~O to him. By unanimous
vote, the board approved the vacation request subject to Mr. Bramhal I)s develop-
ment of a site Screen and landscaping plan for the thirty foot buffer adjacent
to his property. Such a plan would be reviewed by the planning department to
ensure the landscaping plan is desirable and in keeping with the goals and
intent of the greenbelt creation.
On March 13, 1984, the board reviewed the agreement between the county and
Clarence Bramhal I regarding the landscaping of the greenbelt adjacent to
Block 19 of the Eisenbeis Bay View Addition. The agreement, signed by Bramhal I,
describes the planting schedule to be completed within the greenbelt area by
Bramhal I prior to March 1, 1985. Contingent on the termS of the agreement, the
board approved the request to vacate the al ley within Block 19.

Enclosed is a check in the amount of $25.66 as refund on your deposit
for expenses incurred by the County for the processing of your
petition to vacate the above noted alley.
Also enclosed for your file are copies of the Order to Vacate, Agree-
ment, findings and final determination, and billings. Both the Order
