ORDER OF VACATION
PORTION OF MASON STREET AND 12TH AVENUE AND
LOTS 2 THROUGH 8. BLOCK 6. AND LOT 1, BLOCK 7, OF
HESSIAN GARDEN TRACTS
This matter coming to be heard on this it!- day of April. 198'1 upon the
report of the Jefferson County Public Works Department and Jefferson County
Planning and Building Department with respect to the vacation set forth in a
"Petition for Vacation of a County Road" submitted by Ulmer Anderson, and it
appeared to the Jefferson County Board of Commissioners that a notice of the
hearing had been posted and published for the time and in the manner provided by
law, proof of such posting and publication being now on file herein, and said
board having the other evidence adduced, and being fully advised in the premises,
does now find and determine that the public will be benefited by the vacation
thereof.
NOW, THEREFORE, BE IT RESOLVED, AND IT IS HEREBY ORDAINED, that
the following be vacated amd abandoned pursuant to RCW 36.87.140:
1. Mason Street right-of-way lying northerly of and adjacent to Lots 2 through
8 of Block 6 of Hessian Garden Tracts, being 275 feet in length with varying
widths.
2. 12th Avenue right-of-way lying between Lot 8 of Block 6 and Lot 1 of Block 7
of Hessian Garden Tracts, being 100 feet in length and 50 feet in width,
3. Lots 2 through 8 of Block 6 and Lot 1 of Block 7 lying northerly of Kennedy
Road in the Hessian Garden Tracts.
BE IT FURTHER RESOLVED that compensation, specified under Jefferson
County Road Vacation Ordinance 2-76, shall be made by Ulmer Anderson through the
dedication of ad?itional right-of-w~y f?r ~ennedy Road as per th~ s)atutory
warranty deed ftied under the audItor's fIle (Volume b2, Page b J

COUNTY ROAD AND LOT VACATION PETITION Rl-84
REQlJEST
The request is to vacate the Mason Street right-of-way lying northerly of
and adjacent to Lots 2 through 8 of Block 6 of Hessian Garden Tracts. This
unimproved right-of-way is approximately 275 feet in length with varying widths.
Additionally, the request is to vacate the unimproved 50 foot wide by 100 foot
long right-of-way of 12th Avenue lying between Lot 8 of Block 6 and Lot 1 of
Block 7 within the same plat. The petitioner further requests the vacation of
Lots 2 through 8 of Block 6 and Lot 1 of Block 7 lying northerly of Kennedy Road
in the Hessian Garden Tracts.
These lots and adjacent rights-of-way are located west of Rhody Drive in the
Tri-Area within Section 3, Township 29 North, Range 1 West. WM. Kennedy Road
runs in a westerly direction from it's conjunction with Rhody Drive.
The principle petitioner requests this vacation for several reasons. The
petitioner owns the adjacent forty acres north of the above described lots. He
notes the sliver of Mason Street right-of-way between his lots and the forty acre
parcel is not useable for road construction. Public access within the area is
provided by Kennedy Road. Vacation of this right-of-way would facilitate contigu-
ous property boundaries. Since he plans on vacating the lot lines of the above
described property, he would like this 12th Avenue right-of-way to be vacated
also to facilitate contiguous property boundaries.
FINDINGS
1. A petition for vacation of a county road is made pursuant to the Jefferson
County Road Vacation Ordinance and is subject to its requirements and
criteria. _
2. A petition for vacation of lots is made pursuant to the provisions of
RCW 58.11.
3. The proposed vacation is not within a designated trail corridor of the
Jefferson County Park, Recreation, and Open Space Plan.
4. The optimum land use map of the Tri-Area Community Development Plan
designates the area of the proposed vacation as rural residential. The
goals and policies of the motorized and non-motorized transportation and
circulation sections of the plan apply to this proposal.
5. Notice of the proposed vacation was made to the following agencies by mail:
a. Jefferson County Public Works Department: Recommends approval contin-
gent on Condition of Approval 1. A road crew was sent to the area and
determined Mr. Anderson's houses (one on Lot 2 and one on Lot 3) are
about thirty-seven to forty feet from the centerline of the existing
Kennedy Road.
b. Jefferson County Assessor's Office: The assessed value of the vacation
request area is $375.00.
c. Jefferson County Sheriff's Office: No response.
d. Emergency Services Council: No objection.
e. Port Townsend Utilities Department: No objection since the water line
runs along the constructed Kennedy Road right-of-way.
f. Pacific Northwest Bell Telephone Company: No objection since the tele-
phone line runs along the constructed Kennedy Road right-of-way.
g. Puget Sound Power and Light Company: No objection since the power line
runs along the constructed Kennedy Road right-of-way.
h. Chimacum Fire Protection District 1: No response.
6. Notice of the proposed vacation was made to the adjacent property owners.
No responses were received.
7. Review of the proposed vacation by the Jefferson County Planning Commission
is scheduled for March 14. 1984. Notice of the meeting was made by mail to
all petitioners and abutting property owners.
8. A public hearing has been scheduled by the Jefferson Co'unty Board of Commis-'
sioners for March 19. 1984 at 10:30 a.m. in their chambers at the county
courthouse in Port Townsend. Public notice of the hearing was made by
publishing legal notices in the March 7 and 14, 1984 editions of the Port
Townsend Leader and posting the subject site with notices.

CONDITIONS OF APPROVAL
1. Thirty feet of rigbt-of.way from tbe centerline of the current alignment of
Kennedy Road along the Anderson property boundary shall be dedicated to the
county.
PLANNING COMMISSION ACTION
At their meeting on March 14, 1984, the Jefferson County Planning Commission
reviewed the request and findings. Ulmer Anderson spoke on behalf of the
request. He stated that if the condition of approval were required, he would
withdraw the request. He would be willing to dedicate ten feet of his property
along the northerly edge of Kennedy Road to the county in exchange for the
vacation of Mason Road. Brian Shelton, director of the Jefferson County Public
Works Department, stated this would be acceptable.
By formal vote, the planning commission recommended the board approve the
vacation request subject to the revised condition that reads, "Twenty feet of
right-of-way from the centerline of the current alignment of Kennedy Road along
the Anderson property boundary shall be dedicated to Jefferson County."
BOARD OF COMMISSIONERS ACTION
At the public hearing on March 19, 1984, the Jefferson County Board of
Commissioners reviewed the request, findings, and planning commission action.
Ulmer Anderson spoke on behalf of the request. He stated that his fence is
eighteen feet from the road pavement and, therefore, he only wanted to dedicate
eighteen feet from the centerline of the road to the county. Brian Shelton
discussed the need to review a possible realignment of Kennedy Road to suit the
needs of adjacent property owners and the county. The board continued review of
the request until April 2, 1984 to allow the public works department the opportun-
ity to research realignment possibilities.

At their meeting on April 2, 1984, the board reconvened the hearing.
Mr. Anderson offered to dedicate to the county 1.9 feet at the east end of his
lots and 10 feet at the west end of his lots. He stated that if the county did
not agree to this, he would withdraw his request. Brian Shelton stated that the
additional right-of-way would aid future improvements. The public works depart-
ment will prepare a legal description of the area to be conveyed to the county by
Mr. Anderson. The board tabled the vacation discussion until April 9, 1984 to
allow the public works department and Mr. Anderson the opportu~ity to define the
property conveyance.
At their meeting on April 9, 1984, the board reconvened the hearing. Brian
Shelton presented a statutory warranty deed from Mr. Anderson to the commis-
sioners conveying additional right-of-way along Kennedy Road to the county.
Based on this, the board approved the vacation request.

The principal petitioner shall contact the Jefferson County Public Works Department
for legal description of right-of-way to be vacated.
The principal petitioner shall submit to the Jefferson County Board of Commissioners
a complete petition, accompanied by a bond in the pencl sum of one hundred dollars
($100.00) to cover county processing expenses. Checks or money orders shall be
made payable to the Jefferson County Commissioners Revolving Fund.
The principal petitioner shall include with the petition a map suitable for repro-
duction that is no larger than 8~ by 11 inches showing to a reasonable scale: (a)
the county road, or portion thereof, proposed to be vacated; (b) the property loca-
tion and names of all petitioners; (c) the property location and names of all adja-
cent property owners who did not sign the petition, with an attached list of their
addresses; and (d) the nearest constructed county road to the proposed vacation.
(This info~ation can be found in the Jefferson County Assessor's Office, Jefferson
County Public Works Department, and/or a local title company.)
The principal petitioner is requested to be present at the meetings of the Jefferson
County Planning Commission and Board of Commissioners when this petition is con-
sidered.

We, the undersigned, being ten freeholders residing in Jefferson County, do hereby
respectfully petition the Jefferson County Board of Commissioners for vacation of ~he
following described county road in Jefferson County. (Include in the description ,the
length and UJidth of right-of-way to be vacated.) : All t hat po rt i on of th e
dedicated right of way being approximately 745 in length, with
varying widths, lying northerly of and adjacent to Lots 2 through 8
of Block 6~ and the 50 feet in width by approximately 100 feet in
length right of way of 12th AVenue lying between Lot 8 of Block 6
and Lot 1 of Block 7, all in the Plat of Hessian Garden Tracts,
as recorded in Vol. 2, Page 134 of Plats, records of Jefferson County.

The principal petitioner hereby acknowledges: (a) Jefferson County may retain an
easement within the subject vacated area for the construction, repair, and maintenance
of public utilities and services, pursuant to R.C.W. 37.87.140 and Section 5 of the
Jefferson County Road Vacation Ordinance; and/or (b) Jefferson County may retain an
easement within the subject vacated area for trail or pathway purposes, pursuant to
Section 5 of the Jefferson County Road Vacation Ordinance; and/or (c) Jefferson County
may require compensation by the principal petitioner and/or benefiting property owners
as a special condition for granting approval of the petition, pursuant to R.C.W.
36.87.120 and Section 6 of the Jefferson County Road Vacation Ordinance.
The principal petitioner also acknowledges that he or she shall compensate the
county for any additional expenses incurred in the processing of said petition, which
may exceed the one hundred dollar ($100.00) bond. Checks or money orders for said bond
and/or expenses shall be made payable to the Jefferson County Commissioners Revolving
Fund.
