GRANTING FRANCHISE ON COUNTY ROAD RIGHTS-OÞ-WÀY)

WHEREAS,> hearing on t,he said Application was held before the
Board of Couqty Commissioners of Jefferson County, Washington, on

pursuant to te provisions of~W 36.55, after notice given ,as
required by/law, and
WHEREAS ,!Tit appears to be in the public interest to grant the
said franchise request, NOW, THEREFORE,
!T ISHEIŒBY RESOLVED that a 'franchise be and it is hereby
granted to the applicant named above (GRANTEE) for a period of
twenty-five (25) years from the date of this Resolution, to in-
stall, operél~ca, maintain, repair and use, an existinq water
system which <was constructed in 1966
in, under, 'along and across that porti'on of county road rights-of-
wä'y described as follows: '
Div£s~onI of Lazy C Ranch as recorded in Vol. 5
of ~~4ts, Pages 9-11, and Div. III of Lazy C Ranch
asreporded in Vol. 5 of Plats, Pages 61-63, records
ofŒe~ferson County.

This franchise is granted upon the following express terms, and
condi tions: '
(1) The said GRANTEE, its succ~ssors and assigns, shall have
the right to enter only upon the above-described rights-of-way for
the purpose of constructing its facilities and for operating,
maintaining ,repairing a~ld using those facilities.
(2) The terms and conditions of Jefferson County Ordinance
N~. 2-81 , an ordinance prescribing terms and conditions for
franchise'agreernents granted by Jefferson County, are incorporated
herein by reference and made a part of this Resolution for all
purposes as fully as if set forth in this Resolution. The GRANTEE,
for itself, its successors and/or assigns, expressly agrees that
it will strictly comply with the requirements of the said ordinance
and any amendments thereto. GRANTEE understands and acknowledges
that the ordinance requires it to obtain a permit from the County
jEngineer/Director of Public Works before doing work under this fran-
cise and perfòrming other actions relating to the franchised matter.

(3) The GRANTEE shall submit a facility plan to the County
Planning Depa~tment for review of all new proposed facilities, ex-
clusiveof service connections and appurtenances. Construction
permits willþe granted upon the determination that the facility
plancomplies'W"ith the county comprehensive plan.
(4) The GRANTEE shall commence construction work under this
franchise only after the effective date hereof, and after first
securing necessary approvals and permits from the County Planning
Department.and;.the Department of Public Works.
(5) The full acceptance of this franchise and all its terms
and conditions within thirty (30) days from this date, by the
GRANTEE. in wr~ting, is to be filed with the Clerk of the Board
of County Commissioners of Jefferson County and shall be a condition
precedent to taking effect, and unless the franchise is accepted
within such , this grant shall be null and void.

I hereby accept the terms and condition$ specified under
Ordinance No. 2-81, for a Non-Exclusive Franchise granted to Lazy C Club.
Inc.. WA Non-Profit Corp. ,for construction, operation and maintenance
of water lines a10n~ and across the c~unty road right-of-ways des-
cribed in Resolution No. 65- 84 approved by the Board of Jeff·erson County
Commissioners on the 15th day of October , 1984.
