Jefferson County Camping and Park Lands Ordinance SECTION PURPOSE The purpose of this ordinance is to establ Ish rules and regulatIons regarding the care, control, supervision, and operation of al I county park lands and their use. SECTION 2 DEFINITIONS For the purpose of this ordInance, the fol lowing words shall have the meanings as st~ted: 1. BOARD: The Jefferson County Board of CommIssIoners. 2. CAMPER: A motorized vehièle containing sleeping and or housekeeping accommodations; includes a pick-up truck with a camper, van-type body vehicle, converted bus, or similar type vehicles. 3. CAMPING: Erecting a tent or shelter or arranging bedding or both or parking a trailer, camper, or other vehicle for the purpose of remaining overnight. 4. CAMPING UNIT: The primary means of shelter being uti I ized for overnight camping; includes a tènt, van, trailer, camper, recreattónai vehicle, and similar units. 5. CAMPSITE: A designated camping site that is designed for overnight use by persons with a camper, trailer, tent, or other means to provide sleep- ing arrangements. 6. LAW ENFORCEMENT OFFICIAL: Any duly constituted and credentialed law enforcement officer. 7. PARK ATTENDANT: The person des i gnated by the Jefferson County Board of Commissioners responsible for park maintenance, fee collection, and implementing compliance with al I park rules and regulations. 8. PARK LAND: Any park land under the administration and management of Jefferson County. 9. PERSON: Any person, firm, partnership, corporation, club, and any association, or combination of persons acting for themsèlv9S or by an agent, servant, or employee. 10. TRAILER: A towed vehicle that contains sleeping or housekeeping accommo- dations. SECTION 3 SCOPE This ordinance shal I apply to al I county park lands owned and managed by Jefferson County. -1- VOL 9 llrr r....,¡.. o 1854 SECTION 6 CONCESSIONS AND VENDING The vending of various goods, services, products, or commodities, including mobile vending, is permitted on park lands with the prior written provision by the Jefferson County Board of Commissioners. The vending of any such goods, services, products, or commodities without written permission is proh i b ited. SECTION 7 FIRES 1. The kindl ing of any fire is permitted only in designated camping and piénic grounds and only if the fire is confined in a fireplace provided for the use of visitors, or in gril Is or other specified locations or in stoves or lanterns using gasol ine, propane, butane gas, or simi Jar fuels. 2. When no longer needed, the fire shal I be completely extinguished. Leaving a fire unattended is prohibited. 3. Throwing or dropping a I ighted cigarette, cigar, match, or other burning material is prohibited. 4. The kindling of fires on park lands may be prohibited when potential damage makes such action necessary. 5. The park attendant, during such periods when potential fire danger makes such action necessary, may prohibit combustion of any kind on any park lands, including roads and trails, by the posting of appropriate signs. 6. The kindling of fires is expressly prohibited on any park land beach. SECTION 8 SANITATION 1. AI I garbage, cans, bottles, waste materials, and rubbish of any kind must be deposited in proper receptacles designated for such disposal or removed from the area. 2. Drainage or dumping refuse or wastes from any trailer or other vehicle, except in places or receptacles provided for such use, is prohibited. 3. Cleaning food, fish, or fowl, or washing clothing, vehicles, campers, or articles of household use at campground hydrants is prohibited. 4. Pol luting or contaminating in any manner any watershed, water suppl ies, or water used for drinking purposes is prohibited. 5. Depositing any body waste In or on any portion of any comfort station or other publ ic structure, except into fixtures provided for such purposes, is prohibited. Placing garbage, rubbish, or foreign materials in any of the plumbing fixtures of comfort stations is prohibited. 6. Using refuse containers or other facil ities for dumping household or commercial garbage or trash brought as such from private property is proh i b ited. SECTION 9 NOISES AND OTHER NUISANCES 1. The use or operation of any noise producing instrument, device, or equip- ment in a manner that annoys persons or creates a nuisance is prohibited. 2. The operation or use of a publ ic address system is prohibited, except when such a system is authorized by the board or designated representative. 1:: ·...3- VOL 9 '!rc r...,,_ o 1855 · .... , SECTION 4 CAMPING 1. Camping shall only be permitted in parks designated be¡ the board of comm i ss iooer-s.' 2. Camping and the use of trai lers or other camping units is permitted only at designated locations. Within designated locations, the pitching of tents or parking of trai lers or other camping units is permitted only at designated campsites. The number of vehicles occupying a single campsite at one time shal I be I imited to one car, one camper, or one vehicle with a tra i I er . 3. Temporary occupancy of the same campsite by the same person or persons shal I be limited to seven (7) days, unless otherwise authorized by the board. At the end of the seventh day, the person or persons, along with their ca~ping vehicle or vehicles, must vacate the campground for a mini- mum of forty-eight (48) hours. 4. Permanent occupancy by the same person, group of persons, or organization of any park, portion of a park, or faci lities within a park is prohibited except by those county employees authorized to set-up residency within park boundaries by the board. 5. Fees fór overnight camping wi I I be collected beginning the first day of May and ending the last day of September. 6. The fee for overnight camping shal I be up to five dollars ($5.00) per camping unit or three dollars ($3.00) per camping unit with proof of residency in Jefferson County. Persons sixty (60) years or older may receive a one dollar ($1.00) discount with proof of age. 7. Fees for the use of campsites are due in advance by initially occupying a campsite and thereafter are payable daily. The campsite fee covers exclusive temporary occupancy of the campsite unti I the vacating time of three o'clock (3:00) p.m. the fol lowing day. 8. A campsite is considered occupied when it is being used for the purpose of camping by a person or persons who have paid the campsite fee within the appl icable time I imits. No persons shall take or attempt to take possession of a campsite when it is being occupied by another party or when informed by the park attendant that such a campsite is occupied or otherwise unavai lable. 9. Occupants shal I vacate camping facil ities by removing their personal property therefrom prior to three o'clock (3:00) p.m. if the appl icable campsite fee has not been paid or if the time limit for occupancy óf the campsite has expired. The occupants may, however, remain in other areas of the park for purposes other than camping unti I the normal closing time of the park. SECTION 5 PARK HOURS AND CLOSURES 1. The board may establ ish a reasonable schedule of visiting hours for a park or portions of a park area. The board may close to public use any portion of a park area when necessary for the protection of that area or for the safety and welfare of persons or property. Notification identifying the extent and scope of such scheduling or closure shal r be made by the post- ing of appropriate signs. 2. Creating a nuisance by any act or gesture or unreasonable loud noise is prohibited. 4. Discharging firearms on county park lands is prohibited. SECTION 10 DOGS, CATS, AND OTHER PETS AND LIVESTOCK 1. Dogs, cats, and other pets are prohibited unless they are on a leash or otherwise under restrictive control of the owner at al I times when inside park lands. 2. The owner of a dog, cat, or other pet is directly responsible for the behavior of the animal and shal I not al low the pet to create a nuisance to other park users or deface park lands. 3. Grazing or ranging of domestic animals Is prohibited. SECTION 11 PRESERVATION OF PUBLIC PROPERTY 1. The possession, destruction, injury, defacement, removal, or disturbance in any manner of any bui Iding, sign, equipment, monument, statue, marker, or other structure, or any other public property of any kind, is prohibited. 2. Entering, climbing upon, or tampering with county owned motor vehicles and motorized or power equipment, except by authorized county employees, is proh i b ited. SECTION 12 TRESPASS Trespass onto private property, Including beaches and tidelands, is prohibited. SECTION 13 LEGAL PROVISIONS 13.10 Severabil ity If any section, subsection, or other portion of this ordinance is for any reason held inval id or unconstitutional by any court of competent juris- diction, such section, subsection, or portion shal I be deemed a separate portion of this ordinance and such holding shal J not affect the val idity of the remaining portions of this ordinance. 13.20 Repealer AI I rules, reguJations, and ordinances of Jefferson County in confl ict with this ordinance are hereby repealed.. -4- VOl 9 f~Œ 01857 ,I" r ~. ....1 " .. 13.30 Effective Date This ordinance shall become effective this 1st<day of July, 1983. 13.40 Adoption The Jefferson County Camping and Park Land Ordinance is hereby adopted by the Jefferson County Board of Commissioners this l3'fh day of June, 1983. Any person may submit written or oral comments at this public hearing with respect to the contents and adoption of this ordinance. Sections of the ordinance are presented below in summary. Information pertaining to the ordinance and copies thereof may be obtained from the Jefferson County Commis- sioners' Office (County Courthouse, Port Townsend, Washington 98368). SUMMARY Section 1. Purpose: This section defines the intent of the ordinance. Section 2. Definitions: This section defines key words and phrases used throughout this ordinance. Section 3. Camping: This section places limitations on the occupancy of campsites within county parks and establisheS fees for overnight camping. Section 4. Closures: This section addresses park hours and the closure of areas open to use by the public. Section 5. Concessions and Vending; . This s.ect:ion requires written permission from Jefferson County for the'~èndirtg of~ any goods and services on park lands. Section 6. Dogs, Cats and Other Pets: This section establishes the conditions under which pets are allowed on park lands. Section 7. Fires: This section outlines the conditions under which fires are allowed on park lands. Section 8. Nuisance: This section prohibits the creations of nuisances. Section 9. Preservation of Public Property: This section ad- dresses the abuse or unauthorized use of county property or equipment. Section 10: Sanitation: This section establishes rules for waste disposal. Section 11. Trespass: This section prohibits trespass onto private property. Section 12. Severability Section 13.
