HomeMy WebLinkAbout029 83RESOLUTION NO. /?__, 3 A RESOLUTION DECLARING A NON - DEBATABLE EMERGENCY AND APPROPRIATING FUNDS TO THE CURRENT EXPENSE NON - DEPARTMENTAL BUDGET FOR PAYMENT OF A CIVIL SUIT INVOLVING SIMCOE V. BRUECKMANN ET AL WHEREAS, there is an immediate need to appropriate funds within the 1983 Current Expense Budget to allow payment of costs mandated by the Court in a Civil suit involving Simcoe v. Brueckmann and Jefferson County; and WHEREAS, the amount necessary to provide for payment of the said Civil suit was not anticipated at the time of preparing the 1983 Budget, and a new line item within the Non - Departmental portion of the Current Ex- pense Budget was established to allow payment of such costs, and the amount of $104.55 needs to be added to the said new line item for payment of costs incurred in the above noted Civil suit; and WHEREAS, payment of the said Civil suit is a mandated expenditure required by law and thus constitutes a non - debatable emergency within the provisions of RCW 36.40.180; now, therefore, BE IT RESOLVED, that a non - debatable emergency is hereby declared and that the amount of $104.55 be added to the Current Expense Non- Depart- mental Budget under BARS account no. 519.20.49 for payment of Mandate No. 10280, Statement of Costs and Disbursements to be Taxed Against Defendants Brueckmann and Jefferson County, all without further notice of hearing as provided by law.
