THIS MATTER coming to be heard on the 6th day of June, 1983, upon
County Road Engineer's report and the County Planning Department's report
with respect to the vacation set forth in "Petition to Vacate a County
Road" submitted by David R. Smith, and it appearing to the Board of County
Commissioners that notice of hearing had been posted and published for the
time and in the manner provided by law, proof of such posting and publi-
cation being now on file herein, and said Board having the other evidence
adduced, and being fully advised in the premises, does now find and deter-
mine that the public will be benefited by the vacation thereof; now,
therefore,
BE IT RESOLVED, and it is HEREBY ORDERED that:
All that portion of the approximately 127 feet in
length by 74 feet in width Right-of-Way of "D"
Street, lying between Lots 1, 2 and 3 of Block 4
and 9, 10 and 11 of Block 3 of the Plat of South
Port Townsend, as recorded in Volume 1, Page 10
of Plats, records of Jefferson County.
AND: Lots 1 (enlarged by vacated portion of Fourth
Street, vacated 5-30-52), 2 and 3 of Block 4 and
Lots 9 (enlarged by vacated portion of Fourth Street
vacated 5-30-52), 10 and 11 of Block 3 of the Plat
of South Port Townsend, as recorded in Volume 1,
Page 10 of Plats, records of Jefferson County
be, and the same are hereby vacated and abandoned pursuant to RCW 36.87.140.
BE IT FURTHER RESOLVED, that said petition is exempt from compen-
sation requirements specified under Ordinance No. 2-76, except for the
expenses incurred by the County for investigation, examination, publication
