JEFFERSON COUNTY, WASHINGTON
RESOLUTION NO. 58-83
A RESOLUTION of the Board of County Commission-
ers, Jefferson County, Washington, concerning the
costs of road improvements in Road Improvement
District No.1 and Road Improvement District No.2.
WHEREAS, the County Commissioners (the "County Commission-
ers") may provide for the construction, improvement and mainten-
ance of county roads under Chapter 36.75 RCW, and may pay for
the costs of such construction, improvement and maintenance
through the county road fund under Chapter 36.82 RCW; and
WHEREAS, the County Commissioners may, under RCW 36.88.010
and RCW 36.88.190, pay for part of the costs of county road
construction, improvement and maintenance by means of assess-
ments against properties specially improved by such construc-
tion, improvements and maintenance and included within road
improvement districts established pursuant to Chapter 36.88 RCW;
and
WHEREAS, by Resolution 61-81, the County Commissioners
established Road Improvement District No. 1 for the improvement
of Griffith Point Road, and established a Road Improvement
District No. 1 Fund; and provided for payment of the costs of
the improvement in part and by assessment against property
owners within Road Improvement District No.1; and
WHEREAS, by Resolution 70-81, the County Commissioners
established Road Improvement District No. 2 for the improvement
of Sentinel Firs Road, and established Road Improvement District
No. 2 Fund, and provided that all of the costs of the improve-
ment would be borne by property owners within Road Improvement
District No.2; and
WHEREAS, by Resolution 38-83, the County Commissioners
established Consolidated Road Improvement Districts Nos. land

2, and established a Consolidated Road Improvement Fund,
Districts Nos. land 2, for the purpose of more efficiently
financing the costs of improvements in those two road improve-
ment districts; and
WHEREAS, the improvements in Road Improvement Districts
Nos. land 2 (the "Improvements") have been completed, and
payment for the Improvements has been made out of the Jefferson
County Road Fund, such fund to be reimbursed by money collected
from assessments against property owners within Road Improvement
Districts Nos. land 2; and
WHEREAS, although RCW 43.09.210 requires that money trans-
ferred from one fund to another must be paid for at its true and
full value, including interest; and
WHEREAS, in determining the cost of the road improvements
in Road Improvement Districts Nos. 1 and 2, the interest costs
of borrowing from the County Road Fund for the improvements in
those districts were not taken into account; and
WHEREAS, the County Commissioners desire to contribute from
the County Road Fund to the full and true cost of the Improve-
ments, the amount of money equal to the cost of interest pay-
ments that would otherwise be made by those road improvement
district funds to the County Road Fund, minus any interest
payments made by the Consolidated Road Improvement Fund,
Districts Nos. 1 and 2 Fund from such money as may be available
after the reimbursement to the County Road Fund for all costs of
the Improvements, including all costs of issuing bonds; and
WHEREAS, the County Commissioners find that 8% is a reason-
able and appropriate amount for interest payments upon the money
paid out of the County Road Fund for improvements in Road
Improvement Districts Nos. 1 and 2; NOW, THEREFORE, BE IT
RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF JEFFERSON
COUNTY, WASHINGTON, as follows:

Section l. The interest amount to be paid by the Consoli-
dated Road Improvement Fund, Districts Nos. I and 2, to the
County Road Fund, for money expended from the County Road Fund
for improvements in Road Improvement Districts Nos. land 2, to
be repaid after the sale of road improvement district bonds, is
hereby established to be eight percent (8\).
Section 2. The County Commissioners order that the inter-
est costs owed by Road Improvement Districts Nos. 1 and 2 to the
County Road Fund for the use of money from the County Road Fund
to pay for improvements in those road improvement districts,
shall be deemed a contribution by the County from its County
Road Fund to pay for part of the cost of the improvements in
those road improvement districts, except for that amount remain-
ing in the Consolidated Road Improvement Fund, Districts Nos. 1
and 2 after the County Road Fund is reimbursed for the costs of
the Improvements, including all costs of issuing bonds, which
remaining amount of the interest cost shall be reimbursed by
Road Improvement District Fund Nos. land 2 to the County Road
Fund.
Section 3. This Resolution supersedes all previous resolu-
tions of the County Commissioners to the extent that they
conflict.
Section 4. The previous acts of the County, its officers,
employees and agents, consistent with this Resolution, are
hereby ratified and confirmed.
Section 5. If any provision of this Resolution, or its
application to any person or circumstances, is held invalid by a
court of competent jurisdiction, the remainder of the resolu-
tion, or the application of the provision to other persons or
circumstances, shall not be affected.

Section 6. This Resolution shall be in full force and
effect after its passage and publication as required by law.

Re: Interest Contribution Resolution
Dear Ms. Bragg:
The enclosed resolution was drafted to take care of a technical
problem that arose in connection with Road Improvement Districts
Nos. 1 and 2.
When the cost of the improvements in those RID's was estimated
it did not include the interest costs that would have to be paid to
the County Road Fund for the use of money from that fund to carry out
the improvements. The County Road Fund will be reimbursed for
construction costs when the bonds are sold, but there is no money
readily available to pay for the interest costs.
This resolution contributes from the County Road Fund to the
consolidated Road Improvement District Fund an amount equal to the
interest costs, minus the small amount that will be left over after
all of the other costs are paid. I spoke to Mr. O'Meara about this
issue, and he stated that he wanted to have whatever funds were
remaining after the bonds were sold, paid back to the County Road
Fund as interest costs. Any interest costs above and beyond that
small figure would be counted as a contribution by the County Road
Fund to the Road Improvement Districts.

As part of this process, after the Bond Closing we will also draft
a short Resolution to make sure that the County budget reflects the
exact amounts transferred from the County Road Fund to the consolidated
RID Fund.
