RESOLUTION NO. 66-83
ORDER
BUDGET APPROPRIATION
CONTRIBUTION TO FAIR TOLL COALITION
FROM FEDERAL REVENUE SHARING FUND
WHEREAS, the Board of Jefférson County Commissioners, did, on
the 27th day of June, 1983, declare that an emergency existed to provide
the sum of $2,000.00 for the Fair Toll Coalition to assist with legal ex-
penses incurred in their action against the Washington State Department of
Transportation to achieve equity in the setting and administration of tolls
collected on the Hood Canal Bridge, and set a hearing on said emergency for
Monday, the 11th day of July, 1983, at the hour of 11:00a.m.; and
WHEREAS, notice of said hearing was published as required by law;
and
WHEREAS, this being the time and place set for said hearing and
no objection or objection interposed; now, therefore,
IT IS HEREBY ORDERED, by the Bòard of Jefferson County Commis-
sioners, that the County Treasurer bé, and she is ~)Y authorized to
1990 Federal Revenue
transfer the amount of $2,000.00 from the unencumbe -~~~~~~

fund bãlance into Current Expense Fund No. 125, Non-Departmental, for the
Fair Toll Coa1itiòn; and
IT IS FURTHER ORDERED, that the County Auditor is hereby authori-
zed to include the said sum of $2,000.00 in the Non-Departmental Budget for
1983, under BARS account no. 519.20.49, to be used as a contribution to the
Fair Toll
Coalition. ~

HE: Fair Toll Coalition -- Hood Canal Bridge 'rolls,.
Gentlemen:
The Fair Toll Coalition is now proceeding with litigation under
Case No. 82-2-01388-6 in the Thurston County Superior Court, Judge
Dorë:1,n:presiding. On the 22nd of June, Judge Doran granted a con-
tinuance of the case to permit the Plaintifs to designate the
Federal Highway Administration as an "Indispensable Party" in the
case due tq their role as one of the two agencies that entered into
the 129(A) Agreement of 20 Nay, 1980. Our counsel, Kargianis &
i, ~'
Austin, is noy! moving with negotiations with the Federal Highwa;y;
Administration to make this adjustment to our Complaint and to gain
an assurance that the Federal Highway Administration will be bound
by the rulìng of the Thurston County Superior Court as it pertains
to the determination of an equitable ceiling on the net revenues
be collected from tolls on the bridge.

The efforts of the Fair Toll Coalition to bring this case to
compl$tion have incurred legal and technical support costs approaching
$4.5,.000. The Coaltion has already received about $15,500 in public

anc.iprivate contributions to support our legal efforts. We are now
in need of the generous cOITlInitment of $2,000 made by the Jefferson
County Commissioners during their annual budget proceedings in the
fall; of 1982,.,
