HomeMy WebLinkAbout089 82r RESOLUTION NO. 89 -82 A RESOLUTION ESTABLISHING FIRE PROTECTION DISTRICT NO. 7, DEFINING BOUDARIES THERE- OF & PROVIDING FOR THE FIRST COMMISSIONERS THEREIN AND REPEALING RESOLUTION NO. 49 -82 WHEREAS, on March 1, 1982, there was filed with the Auditor of Jefferson County, a petition for the purpose of forming a fire protection district under the provisions of R.C.W. 52.04.010 et seq., and said Auditor having found and determined that said petition contains a sufficient number of signatures of qualified persons, and having attached thereto her certificate of sufficiency and on March 31, 1982, transmitted the same to the Board of County Commissioners, and said Board, by resolution entered upon their minutes, fixed Monday, May 10, 1982, at the hour of 2 :30 p.m. of said day, at the Commissioner's Chambers in the Jefferson County Courthouse, Port Townsend, Washington, as the time and place for the hearing of said petition; and WHEREAS, at said time and place said petition came on for hearing, proof having been made to the satisfaction of this Board that Notice hereof had been given for the time and in the manner provided by law, and no objection having been made or filed, the Board proceeded to hear the petition and upon conclusion made the following findings: I. That the lands described in the petition will be conducive to public safety, welfare and conveniennce, and should be granted. II. The name on number of the district shall be JEFFERSON COUNTY FIRE PROTECTION DISTRICT NO. 7, and the boundaries thereof shall be and are determined as follows: Beginning at the intersection of a line due south from the center of Sec. 7, Twp. 24N., Rge. 12W, W.M., and the Easterly bank of the Clearwater River, which shall be the True Pointof beginning, thence due South to the NW corner of the SW 1/4 of the SE 1/4 of Sec. 18, Twp. 24N, Rge. 12W, W.M., thence due east to the NE corner of the SW 1/4 of the $E 1/4 of Sec. 18, Twp. 24N., Rge. 12W., W.M., thence due South.to the easterly margin if the Clearater Road, thence South and East along the Easterly margin of the Clearwater Road to the north line of the SW 1/4 of Sec. 29, Twp. 24N., Rge 12W. W.M., thence East to the NE corner of said SW 1/4, thence South to the SE corner of said SW 1/4. thence West to the SW corner of said SW 1/4, thence North to the NW corner of said SW 1/4, thence I VOL FACE X18 - Resolution No. 89 -82 Page 2 i ~- East to the Westerly margin of the Clearwater Road, thence North and West along the westerly margin of the Clearwater Road to the intersection of the east line of the NW 1/4 of the NE 1/4 of Sec. 30, Twp. 24N., Rge. 12W. W.M., thence due South to the easterly bank of the Clearwater River, thence Northerly along the easterly bank of the Clearwater River to the True Point of Beginning, including those portions of the E 1/2 of the NW 1/4 of Sec. 19, Twp. 24N., Rge 12W. W.M. that are west of and adjacent to the Clearwater River. III. That an election be held on Tuesday, the :2nd. day of November, 1982, to determine whether the district shall be organized. The election shall be, so far as possible, called, noticed, conducted and canvassed in the same manner and by the same officials as is provided for a special election in the county to authorize the issuance of bonds for a county purpose, and all such officials shall have full authority to do all things necessary for the purpose of the election. For the purpose of the election, county voting precints may be combined or divided and redefined, and the territory in the district shall be included in one or more election precincts as may be deemed convenient and they shall be defined and a polling place for each designated. The notice of the election shall state generally and briefly the purpose thereof,give the boundaries of the proposed district define the election precincts, designate the polling place for each, mention the names of the candidates for the first commissioners, and name the day of the election and the hours during which the polls will be open. Brown, Chairman Board of Jefferson County Commissioners Jefferson County Courthouse Port Townsend, Washington Re: Fire Protection District No. 7 Dear Chairman Brown: As you will recall, we have had quite a bit of discussion of the establishment of Fire Protection District No. 7, in the West End of Jefferson County. After examining the statute and receiving an opinion from the State Attorney General, it is prudent to have the Fire Protection District be one contiguous entity. By including the Clearwater Road in the Fire Protection District, the District as proposed would be one contiguous entity. Unfortunately, to include the part of the District that includes the Clearwater School, we would have to include part of State Route 101, which we do not have the authority to do at this particular time. I see no legal reason why we cannot simply add to the legal description proposed by the advocates of the proposed district, the legal description of the Clearwater Road. We would, however, have to delete the legal description of the land that includes the Clearwater School. There is also no legal reason why a new petition would have to be signed by the citizens in the area inasmuch as the area that we are adding to the District, to -wit, the Clearwater Road, is uninhabited, thus it is my considered opinion that with the change legal description, which I have attached hereto, that this matter can appear on the ballot on Tuesday, the 14th day of September, without any further action required from the citizens that would be served by the Fire Protection District.
