This matter coming to be heard this day upon the coun:;I?:o~~F ~i~~!~~S
report and the County Planning Department's report with respect to the
vacation set forth in "Petition for Vacation of a County Road" submitted
by Dave H. and Lillian Gastman, and it appearing to the Board of County
Commissioners that notice of hearing has been posted and published for the
time and in the manner provided by law, proof of such posting and publica-
tion being now on file herein, and said Board having the other evidence
adduced and being fully advised in the premises, does now find and deter-
mine that the public will be benefited by the vacation thereof; Now,
Therefore,
BE IT RESOLVED, and it is HEREBY ORDERED that:
That portion of the 60 feet in width by
approximately 120 feet in length right
of way of Dickey Street lying between Lots
1 and 2 of Block 13, and Lots 21 and 22 of
Block 12 of the Plat of the Second Addi-
tion to Trails End Homesites, Inc. record-
ed in Vol. 4, Page 4 of Plats, records of
Jefferson County.

be, and the same is hereby vacated and abandoned
with the stipulation that an appropriate utility
in the Dickey Street right-of-way; and
BE IT FURTHER RESOLVED, that said petition is exempt from compen-
sation requirements specified under Ordinance No. 2-76, except for the
expenses incurred by the County for investigation, examination, publication
and recordi
