'/.. , f~ RESOLUTION NO. 128-82 EQUAL EMPLOYMENT OPPORTUNITY POLICY JEFFERSON COUNTY It is the policy of Jefferson County that all contractors who perform public works construction projects for the County shall comply with the following policies as their standard operating procedures: I. The Contractor shall comply with all state and Federal laws and regulations which are in effect pertaining to non-discrim- ination. II. The Contractor shall accept as his operating policy the following statement which is designed to further the provision of equal employment opportunity to all persons without regard to their race, color, religion, sex, or national origin and to promote the full realization of equal employment opportunity through a positive continuing program: "It is the policy of this Company to assure that applicants are employed, and that employees are treated during employ- ment without regard to their race, religion, sex, color, or national origin. Such action shall include: employment, upgrading, demotion, or transfer; recruitment or recruit- ment advertising; layoff or termination; rates of payor other forms of compensation; and selection for training, including apprenticeship, preapprenticeship, and/or on-the- job training." III. The Contractor shall use his best efforts to solicit bids from and to utilize minority group subcontractors or subcontractors with meaningful minority group and female representation among their employees. Contractors shall obtain lists of minority- owned construction firms from the State Department of Labor and Industries. The Contractor shall use his best efforts to assure subcontractor compliance with their equal employment opportunity obligations. APPROVED and ADOPTED this ~¿1~/day of October, 1982. ( ......... 16.1 General Application 16.1.1 Discrimination in the recruitment, training. and referral for employment is prohibited by Title VII .in the Civil Rights Act of 19.64, Presidential Execu.tiveOrder 11246. and by the Washington State Law against Discrimination, Chapter 49.60 RCW. These special requirements establish mini- mum requirements for affirmative action in fair employment practices and are intended to define and implement the basic nondiscrimination provisions of these specifications. For the purpose of this contract: a. "Minority is defined as Negroes, Orientals (Japanese and Chinese), American Indians, Spanish-Americans (includes Mexican-American, Puerto Rican, and other people with Spanish surnames not otherwise reported). and other (in- cludes Filipino, Korean, Polynesian, Indonesian. Aleut, and Eskimo). See Section 5 below. b.. "Craft" is defined as a recognized construction trade for which minimum wage categories are established by the Depart- ment of Labor and Industries in the trade area of the Owner's project. SECTION 00300 SUPPLEMENTARY GENERAL CONDITIONS Page 12 , J I 1.13 MODIFY GENERAL CO~~ITIONS (cont'd.) 16.2 Goals Compliance 16.2.1 Contractor agrees, and will require his subcontractors to agree to maintain, as a minimum goal, minority representation in each craft or crafts employed on the project in accordance with goals established. within the trade area of the Owner's project. Clallam County: 14 - 30 persons employed (1) minority person 31 - 49 persons employed (2) minority persons. 50 - 71 persons employed (3) minority persons. 72 _ 100 persons employed in a craft will include at least four (4) minority persons. Each craft having less than fourteen persons on the project will be added together and the total will be applied to the goals (as if it were a single craft) to determine the minimum minority representation in that group of crafts. The total of each craft will be determined by adding all persons employed in that craft (e.g., journeyman, apprentices, helpers, etc.) by the General ,Contractor and his sub-contractors on this project. 16.2.2 If the Contractor and sub-contractors have been unsuc- cessful in complying with Section 2a for any craft(s), he shall broaden recruitment, training, and job referral opportunities for minorities by undertaking each of the following: a. Notifying State and Community organizations of opportunities for employment, and retaining evidence of their responses. Trade associations (AGC, NECA, etc.) maintain lists of com- munity organizations that refer minority workers for employ- ment in construction trades. b. Maintaining a file in which is recorded the name and address of each minority worker referred to the Contractor, and spec- ifically what action was taken with respect to each referred worker. (If such worker was not sent to the union hiring hall for referral or if such worker was not employed by the Contractor, the Contractor's file shall document this and the reasons therefor.) c.
