Home My WebLink About080 81 ¡: .., _""j'",.«.,,¡J 1'¡4 '"J _ð, ." /( RESOLUTION NO. 80-81 ESTABLISHING A HOTEL/MOTEL TAX FUND WHEREAS, the Board of Jefferson County Commissioners adopted Ordinance No. 3-81, on the 15th day of June, 1981, pursuant to RCW 67.28, levying a two percent (2%) tax for lodging on hotels, motels, rooming houses, tourist courts and trailer camps, to be collected by the State of Washington'Department of Revenue on behalf of Jefferson County, effective as of June 30, 1981; and WHEREAS, all taxes levied and collected under said statute shall be credited to a special fund in the County Treasurer's Office to be used for the purposes authorized under RCW 67.28; now, therefore, BE IT RESOLVED, that the County Treasurer be, and she is hereby authorized and empowered to establish a special fund to be known as the "Hotel/Motel Tax Fund" from taxes imposed under Ordinance No. 3-81, to be collected by the Washington State Department of Revenue, and remitted from said Department to Jefferson County. ' " " " ''\ "" . t J ;v \ ORDINANCE NO. 3-81 (AN ORDINANCE LEVYING A TAX FOR LODGING ON HOTELS, ROOMING HOUSES, TOURIST COURTS, MOTELS AND TRAILER CAMPS AND THE GRANTING OF ANY SIMILAR LICENSE TO USE REAL PROPERTY, SETTING THE RATE OF TAX AND PROVIDING FOR THE COLLECTION AND DISBURSEMENT OF SUCH TAX.) THE BOARD OF COUNTY Cm·1MISSIONERS OF JEFFERSON COUNTY, WASHINGTON, DOES ORDAIN AS FOLLOWS: Section 1. From and after 30 , 1981, there is here- by levied upon every charge made for odging by a hotel, rooming house, tourist court, motel, trailer camp, and the granting of any similar license to use real property, a tax of two percent (2%) on the charge made, collected by the operator of such establishment and remitted as a part of the regular sales tax collected and paid to the State of Washington. Section 2. For purposes of this ordinance, it shall be presumed that the occupancy of real property for a continuous period of one (1) month or more constitutes a renta1~or lease of real property and not a license to use the said property. The rental or lease of real property shall not be subject to tax imposed by this ordinance. The license to use or enjoy real property shall be subject to the tax imposed by this ordinance. Section 3. The State of Washington, Department of Revenue, shall serve as the collector of the tax imposed herein, which shall be in- cluded within and not as an addition to the regular sales tax of the State of Washington, and said Department of Revenue shall remit the said two percent tax, or such amount as may hereafter be established by ordinance, to Jefferson County. Section 4. The revenues from the tax established by this ordinance shall be used for those purposes authorized by RCW 67.28 in its pre- sent form and as may be hereinafter amended. Section 5. The City of Port Townsend, has enacted Ordinance 1845 in accordance with the provisions of RCW 67.28. Thus, a credit for the full amount of the city tax imposed pursuant to this chapter is allowed against the county tax. ADOPTED this /.s- day of J.¿~ ,198l.
