This matter coming to be heard this day upon the County Road
vacation set forth in
report and the County Planning Department's report with

that notice o~ hearing has been posted and published for the time and in
the manner provided by law, proof of such posting and publication being
now on file herein, and said Board having the other evidence adduced, and
being fully advised in the premises does now find and determine that the
public will be benefited by the vacation thereof;
NOW THEREFORE, BE IT RESOLVED, and it is HEREBY ORDERED THAT:
The north 20 feet and the south 20 feet of the
existing 100 foot right-of-way of County Road
No. 102, State Road Log No. 38000, the Old
Gardiner Highway, between mile post 1.41 (135+
75 Old State Highway Engr. Sta.) on the west end
and mile post 2.45 (191+46.8 Old State Highway
Engr. Sta. ) on the east end excepting there-
from, those portions in and of County Road
104-0.22, "Gardiner Beach Road Loop".
be and the same are hereby vacated and abandoned; and
BE IT FURTHER RESOLVED, that said petition is exempt from compen-
sation requirements specified under Ordinance No. 2-76 except for the
expenses incurred by the County for investigation, examination, publica-
tion and recording.
