ORDER OF VACATION

Thi~:~.~~~~be heard this day upon the County Road Engineer's
report and the County Planning Department's report with respect to the
vacation set forth in "Peti-rion for Vacation of a County Road" submitted
by Robert and Joan Moore, Trustees for Benmoor Enterprises, and it
appearing to the Board of County Commissioners that notice of hearing
has been posted and published for the time and in the manner provided
by law, proof of such posting and publication being now on file herein,
and said Board having the other evidence adduced, and being fully advised

in the premises does now find bnd determine that the public will be
benefited by the vacation thereof;
NOW THEREFORE, BE IT RESOLVED, and it is HEREBY ORDERED THAT:
Section 12 Township 29N, Range
1 W.W.M. The portion of Myrtle
Street and Magnolia Avenue that
lies between the old right-of-
way and the new right-of-way of
County Road No.4, Ness to Flag-
ler Road, as shown on the plan
& profile of CRP #328, approved
February 22, 1971, in Bayview
Addition,
PROVIDED: That portion of Lots 6, 7, & 8
in Block 8 of Kuhnsville lying
Easterly of the Old County Road
be conveyed to the County by
Deed;
be and the same are hereby vacated and abandoned; and
BE IT FURTHER RESOLVED, that said petition is exempt from
compensation requirements specified under Ordinance No. 2-76, except
incurred by the County for investigation, examination,
day of May, 1980.
