RESOLUTION NO. 54-80
ORDER OF VACATION
This matter coming to be heard this day upon the County Road Engineer's
report and the County Planning Department's report with respect to the
vacation set forth in "Petition for Vacation of a County Road" and
"Petition for Vacation of Lots and Blocks" submitted by Discovery
Timber Company, and it appearing to the Board of County Commissioners
that notice of hearing has been posted and published for the time and
in the manner provided by law, proof of such posting and publication
being now on file herein, and said Board having the other evidence
adduced, and being fully advised in the premises does now find and
determine that the public will be benefited by the vacation thereof;
NOW THEREFORE, BE IT RESOLVED, and it is HEREBY ORDERED THAT:
All those portions of Marshall Street,
Barnes Street, Bell Street and Faunt-
leroy Street lying 20 feet west of the
Westerly margin of First Street; and,
all those portions of 6th Street, 5th
Street, 4th Street, and 3rd Street
lying South of the South line of Lots
1 through 4 in Blocks 24, 17, 14, and
7, and all that portion of 2nd Street
lying South of the South line of Bay
Street, and, that portion of Win-
chester Street, lying between the
Easterly margin of 3rd Street and
lying 20 feet West of the Westerly
margin of First Street;
All of Blocks 1,2,3,4,5, except the
Easterly 20 feet, all of Blocks 7,8,9,
10,11,12,13,18,19,20,21,22,23, and
Lots 5,6,7,8, of Block 6, 14, 17, and
24, all within Elkins Addition
be and the same are hereby vacated and abandoned; PROVIDED THAT:
a 20 feet strip of property lying
contiguous to and West of First
Street from Marshall Street north to
Bay Street be deeded to the County for
future easement expansion.
BE IT FURTHER RESOLVED, that said petitions are exempt from
compensation requirements specified under Ordinance No. 2-76, except

publication, and recording.
