RESOLUTION NO. 112-80
AMENDING THE PLAT OF "DISCOVERY BAY HEIGHTS"
WHEREAS, Trico Land Company filed a Plat entitled "Discovery
Bay Heights", under Volume 6, pages 75 and 76 of Plats, records of Jefferson
County Auditor; and
WHEREAS, Trico Land Company filed a document entitled Declaration
of Covenants, Conditions and Restrictions for the "Discovery Bay Heights"
Plat under Auditor's file No. 265885; and
WHEREAS, Article VI, page 11 of the above said Declaration des-
cribes front yard set-backs of thirty (30) feet for those lots fronting
"Olympic Boulevard" of the Plat of "Discovery Bay Heights"; and
WHEREAS, the above said recorded Plat graphically depicts a fifty
(50) foot front yard set-back figure on Lot 33; and
WHEREAS, the intent of Trico Land Company was to establish a
thirty (30) foot front yard set-back on Lot 33 of said Plat, consistent with
said Declarations; now, therefore,
BE IT RESOLVED, to correct said Plat by eliminating the fifty (50)
foot set-back figure on Lot 33 facing "Olympic Boulevard".
