RESOLUTION NO.49-79
WHEREAS, it has been brought to the attention of the Jefferson County Planning
Department and the Jefferson County Board of Commissioners there are descrepancies
within the final plat of the Bishop Short Plat; and
WHEREAS, these descrepancies were not discovered during the normal administra-
tive review of this plat; and
WHEREAS, these descrepancies consist of (1) a difference between the correct
access easement as portrayed on the face of the final plat and the incorrect written
descriptjon underllDeclaration of Easementll and (2) the improper location of the
north-south centerline of Section 35, as portrayed on the face of the plat; and
WHEREAS, a proper description of the access easement has been ascertained and
the portrayal of the north-south centerline of Section 35 is superfluous to the
final plat;
NOW, THEREFORE, BE IT RESOLVED, that the Bishop Short Plat be amended as follows:
1. Corrections be placed on a duplicate mylar and filed with the Jefferson County
Auditor referring this resolution.
2. Delete the north-south centerline of Section 35.
3. Delete descriptive text under IIDeclaration of Easementll and replace with the
correct description reading IIAn easement is hereby reserved for and granted to
the respective owners of Lot 1, 2, and 3 and their respective successors and
assigns for the purpose of ingress, egress, and utilities under and upon a strip
of land 60 feet in width, the centerline which is described as follows: begin-
ning ata point on the south line of Section 35, Township 39 North, Range 1 West,
W.M., a distance of 1854.79 feet east of the southwest corner of said section;
running thence north 16057'0411 east a distance of 240.79 feet; running thence on
a 479.11 footradi us curve to the 1 eft, a di stance of 148.79 feet; runni ng thence
north 0005013411 west a distance of 980.77 feet.1I
