I" , /' RESOLUTION NO. 60-79 ORDER OF COUNTY ROAD VACATION WHEREAS, Petitions filed with the Board of Commissioners a Petition for Vacation of County Road, the said road is known as the Lone Star Road and is described as: Commencing at the intersection of County Road 18-3.50 running thence in a Southeasterly direction to its terminus a distance of one half mile, more or less. The said road being numbered 18-3.50.34, and WHEREAS, notice and proceedings were given and held in accor- dance with RCW 36.87, with proof of notice appearing in the file, and WHEREAS, a public hearing on the vacation was held by the Board of Commissioners on May 7, 1979, and WHEREAS, after receiving and considering the reports from the Public Works Department, County Sheriff's Office, County Planning Commission, Quilcene Fire Protection District #2, and puget Sound Power and Light Company, and receiving other information and evidence at the hearing, the hearing was continued to May 14, 1979 to allow Phil Boling an opportunity to contact his attorney for additional information, anq WHEREAS, hearing on the petition was reconvened on May 14, 1979, at which time additional information was presented by petitioners and by Mr. Boling. After review of all information the Commissioners deter- mined that the said County Road was not useful and that the public would be benefited by the vacation. A motion was then passed authorizing vacation of the Lone Star Road (#18-3.50.34) on condition that an easement be provided over the said roadway for: (1) operation and maintenance of utilities, (2) ingress and egress for emergency service vehicles, and (3) ingress and egress to County Road #18-3.50, and WHEREAS, an easement meeting the requirements of the Commissioners motion of May 14, 1979 has been executed by the necessary parties and filed with the County Auditor under file no. 258233, and all other -1- 5 r~ 1131 VOL 'PACt l,j {, IJ,,9"r';~t j~Jt, ~esolution No. 60-79 requirements have been met, and WHEREAS, the Board of Commissioners finds that the said Lone Star Road is not useful and that the public will be benefited by the vacation thereof; NOW, THEREFORE, IT IS HEREBY ORDERED: That County Road ~f18-3.50.34, commonly known as the Lone Star Road, be and it is hereby vacated. IT IS FURTHER ORDERED, that said petition is exempt from compensation requirements specified under Ordinance No. 2-76 except for the expenses incurred by the County for investigation, examination, publication, and recording.
