RESOLUTION NO. 62-79

ORDER OF VACATION
This matter coming to be heard this day upon the County Road Engine~r's
report and the County Planning Department's report with respect to the
vacation set forth in "Petition for Vacation of a County Road" submitted
by Robert E. Bates, and it appearing to the Board of County Commissioners
that notice of hearing has been posted and published for the time and
in the manner provided by law, proof of such posting and publication
being now on file herein, and said Board having the other evidence
adduced, and being fully advised in the premises does now find and
determine that the public will be benefited by the vacation thereof;
NOW THEREFORE, BE IT RESOLVED, and it is HEREBY ORDERED THAT:
That portion of the alley in Block 5 of
Olsen's Addition to Irondale commencing
at the Westerly Boundary Line between
Lots 5 and 14, running thence East through
said alley to the Easterly Boundary Line
between Lots 9 and 10. A distance of
210 feet, more or less, and 10 feet in
width,
be and the same are hereby vacated and abandoned; and
BE IT FURTHER RESOLVED, that said petition is exempt from
compensation requirements specified under Ordinance No. 2-76 except for
the expenses incurred by the County for investigation, examination,
publication, and recording.
