HomeMy WebLinkAboutPermit Expiration and New Process, Sunfield FarmsJEFFERSON COUNTY DEPARTMENT OF COMMUNITY DEVELOPMENT 621 Sheridan Street | Port Townsend, WA 98368 360-379-4450 | email: dcd@co.jefferson.wa.us http://www.co.jefferson.wa.us/260/CommunityDevelopment January 7, 2022 Subject: Expiration of ZON2006-00007 and SUB2011-00008, Application for Agricultural School Jefferson County has expired the conditional approval under ZON2006-00007 and the binding site plan application under SUB2011-00008, due to additional information not being submitted within 180 days via Jefferson County Code (JCC) 18.40.310(1) and proposes the alternative submittal process outlined below. Case History: Conditional Use Approval from the hearing examiner under ZON2006-00007 requires a binding site plan to be approved to operate the conditional use approval. The pending binding site plan is sever al years outside of the original approval requirements and should no longer be valid. Additionally, binding site plans are a means of a subdivision and should not be used for phased development. This is the incorrect application of a binding site plan. I would like to propose an alternative method to complete this project. New Process Outlined: 1. The applicant will apply for a pre-application conference as required per JCC 18.40.090 (2) to ensure the applicant understands the process and required submittals. 2. The applicants will then apply for a new conditional use permit under JCC 18.20.030(3)(e)(i) for an agricultural school with the full development plan. This would be processed as a Discretionary Use permit in process with a public notice type II administrative process. 3. Following the public notice period and project review, under JCC 18315.040 and 18.20.310(1), the administrator can classify the Discretionary Use Permit as a yes use (type 1 permit), an administrative conditional use, or a full Conditional Use to the hearing examiner. 4. Jefferson County anticipates the proposal would be processed as a Type I permit approval if all of JCC 18.15.040(2) (a-i) can be met. If the previous criteria cannot be met, the proposal would be processed as a conditional use permit. There are a few conditional use processes that may be applicable, but depending on the review of public comment, this would likely remain an administrative conditional use permit review process, not requiring a public hearing. This process would be reviewed under criteria in JCC 18.40.530(1). The proposal would have to also meet the criteria in JCC 18.20.030(3)(e), regardless of the permit process. 5. This would allow the applicants to develop the school as needed with reviews from EH or PW being triggered with each building permit, stormwater permit, or other permit submittals. 6. This is the best method forward because this is an allowed use with permit in agriculturally zoned land and consistent with the goals of agriculturally zoned land. It will give them the freedom to develop the school as funding, need, and time best suites the non-profit. Please let me know if you have any questions about the pre-application permit process.
