Fischbach Clerk of the Board: Lorna Delaney MINUTES Week of September 6, 2005 Chairman Phil Johnson called the meeting to order in the presence of Commissioner David W. Sullivan and Commissioner Patrick M. Rodgers. APPROVAL OF MINUTES: Commissioner Rodgers moved to approve the minutes of August 22,2005 as presented. Commissioner Sullivan seconded the motion which carried by a unanimous vote. PROCLAMA TION re: Proclaiming the Week of September 6 through September 9, 2005 as "Jefferson County Employee Recognition Week": Chairman Johnson read the proclamation designating Jefferson County Employee Recognition Week. Commissioner Sullivan moved to approve the proclamation. Commissioner Rodgers seconded the motion which carried by a unanimous vote. PROCLAMATION re: Proclaiming September 11,2005 as "E-911 Day": Chairman Johnson read the proclamation designating September 11,2005 as E-911 Day. Commissioner Rodgers moved to approve the proclamation. Commissioner Sullivan seconded the motion which carried by a unanimous vote. Discussion and Possible Appointment of Three Representatives to Serve as Urban Growth Area Representatives on the Joint Growth Management Steering Committee: (See also minutes of June 6, 13, and 20, 2005) At the Joint Growth Management Steering Committee meeting on January 26, 2005, it was agreed that three voting members from the IrondalelPort Hadlock UGA be appointed by the County Commissioners. The open positions were advertised in The Leader and five residents of the UGA sent letters of interest and were interviewed by the Board. Since that time, one person has withdrawn their application. Chairman Johnson seconded the motion. Commissioner Sullivan and Chairman Johnson voted for the motion. Commissioner Rodgers voted against the motion. The motion carried. Emergency Management Programs Manager Bob Hamlin and Treasurer Judi Morris representing the County Business Continuity Committee re: Continuity of County Government in Case of an Emergency or Disaster: Over the past year a committee has been working on a process to develop a County Business Continuity Plan to have essential services "up and running" as quickly as possible after a disaster. Judi Morris stated that the Board's support in this effort is crucial because the critical functions and top priorities of each department need to be outlined in the plan. Bob Hamlin added that a Jefferson County-City of Port Townsend Emergency Management Plan was adopted, but it doesn't address government continuity. The loss ofthe Courthouse, and the records and equipment located inside, would be devastating. It is important to have support of all the departments in this process. Commissioner Sullivan moved to approve RESOLUTION NO. 54-05 regarding continuity of government in the case of an emergency or disaster. Commissioner Rodgers seconded the motion which carried by a unanimous vote. PUBLIC COMMENT PERIOD: The following comments were made: it is the right of County employees to have campaign signs in their cars except on election days, and concerns were expressed about the conclusions in the WRIA 17 Plan. APPROVAL AND ADOPTION OF THE CONSENT AGENDA: Commissioner Sullivan moved to delete Item #21 and approve the balance of the Consent Agenda. Letter of Appreciation for Quick Response During Computer Virus and E911 Equipment Failure; Jefferson County Central Services Employees; Sara McIntyre, David Winegar and Mark Peil HEARING re: 2006-2011 Six Year Transportation Improvement Program: Chairman Johnson opened the public hearing. Bruce Laurie, Engineering Services Manager, explained that each year Public Works staff applies a priority rating system to future County road projects and the result is the Six Year Transportation Improvement Program. This program is adopted annually by the Board and is required in order for the County to receive state and federal grant funding to help with road projects. A local match is usually required. There are two types ofprojects listed in the plan: 1) projects that already have the local funding set aside; and, 2) projects that are currently unfunded. The Chair opened the public testimony portion of the hearing. Ezra Eichmeyer, Port Hadlock, stated that the visibility is bad at the intersection of Irondale Road and Rhody Drive and a left hand turn lane needs to be added. Sometimes he has waited five minutes to turn left onto Rhody Drive. On SRI04, over the last six months, his family has had five incidents where they had to pull over to avoid being hit by an oncoming car passing in their lane. He realizes this road isn't the County's jurisdiction, but it is a problem that needs to be addressed. Hearing no further comments for or against the Six Year Transportation Improvement Program, Chairman Johnson closed the hearing. Commissioner Sullivan moved to approve RESOLUTION NO. 57-05 adopting the 2006-2011 Six Year Transportation Improvement Program. Commissioner Rodgers seconded the motion which carried by a unanimous vote. Discussion re: Campaign Signs Within 300 Feet of the Courthouse: Donna Eldridge, Auditor, explained that she requested that the Civil Deputy Prosecuting Attorney rescind an email that he sent out to County employees about removing campaign signs from their cars if they park within 300 feet of the Courthouse because the Courthouse is considered a polling place. She doesn't believe that the County has a right to tell employees they can't have a sign in their car parked in the Courthouse parking lot. However, signs do need to be removed on election day and the Elections Department has historically sent out an email on that day to remind employees. The State law regarding elections changed in 2005 and even the State does not have clear direction on a lot of the new legislation. The Auditor's Office interprets and follows the State law, with regard to elections. Page 4 Commissioners Meeting Minutes: Week of September 6, 2005 ~"o, :~+ :: ",>~~::~ +," .>>,' \. ... 1,1""j;"''\'' Prosecuting Attorney Juelie Dalzell stated that the email sent out from her office is a reasonable interpretation of the law. It is legal advice. In their opinion, the Courthouse is a polling place. Deputy Prosecuting Attorney David Alvarez noted that he sent out a second email with an opinion from the Secretary of State's Office that listed three options regarding this issue, one of which was the opinion that went out in the first email. The Secretary of State's Office also said that there is no definitive answer and that the statute needs to be changed. The Auditor stated that if the County is sued because the Prosecutor's Office has given a legal opinion that employees can't have campaign signs in their cars before election day, she wants it made clear that she was not consulted before the opinion was sent out. There was a discussion about the definition of "electioneering." The Board agreed that they have the authority to.decide whether employees can have signs or other campaign paraphernalia displayed on their cars. Commissioner Rodgers moved to have the County Administrator send a memo to all employees in the Courthouse that they may have campaign signs or other items that show they favor a candidate at any level: State, County, or City, or a particular position on a statewide referenda, displayed in their vehicles except on election days, September 20,2005 and November 8, 2005.
