A RESOLUTION providing for the creation of a supplemental budget
for 'the office of the Treasurer 'to accomplish 'the 1975 refund as ordered in
Resolution ~43-75 and declared an emergency 'to meet 'the same.
WHEREAS, 'the State Supreme Court in ~Arasser & ~Tin'ter Company
v. Jefferson County, 84 Wn. 2d 597 reversed the decision of 'the Jefferson
County Sup.~'~ior Court 'thereby authorizing assessment and levy of 'tax on
timber sale contracts, and
V~rHEREAS, as a result of the said decision of 'the Supreme Court
funds in 'the excess of amoun'ts budgeted were collected, and
~AfHEREAS, 'the Jefferson County Board of Commissioners, by
Resolution No. 43-75, a 'taxpayers refund of 'those amoun'ts collected for
Coun'ty roads and for current expenses in excess of 'the amounts budge'ted,
BE IT THEREFORE RESOLVED tha't 'the addi'tional expense incurred
be funded out of 'the current expense fund RCVV 36.40.140) and repayment 'to
be made to 'the curren't expense by each participating taxing district pursuant
'to RCIAr 84.69.070. The repaymen't of expenses to 'the current expense fund
will be made by 'transfer from each districts funds, and said amount of funds
'to be appropriated for said emergency, is fourteen 'thousand, seven hundred
eigh'ty and 00/100 Dollars ($14,780.00)
BE IT FURTHER RESOLVED 'that no part of the cost of 'the refund
shall be paid by 'the 'taxpayers out of 'the regular tax levies, and
BE IT FURTHER RESOLVED 'that a public hearing be held on said
emergency appropriation and that said hearing be held in the Comm~-ssioners
Chambers, Jefferson County Courthouse, on the llth day of August, 1975, at
'the hour of 10:30 a.m., and that, at said hearing any interes~e[~t 'taxpayer may
appeal~ and be heard for or against the appropriation for such alleged emergency.
