ORDER OF VACATION
This matter coming to be heard this day upon the County Road Engineer's
report with respect to the vacation set forth in "Petition for Vacation of
a County Road" submitted by Homer H. Tobin, and it appearing to the Board
of County Commissioners that notice of hearing upon said Engineer's report
has been posted and published for the time and in the manner provided by
law, proof of such posting and publication being now on file herein, and
said Board having the other evidence adduced, and being fully advised in
the premises does now find and determine
That the public will be benefited by the vacation thereof;
NOW THEREFORE BE IT RESOLVED, and it is HEREBY ORDERED THAT:
that portion of Denison Street between Pioneer
Avenue and Maple Avenue, together with the
south 1/2 of Block 22, and the north 1/2 of
Block 35 in Captain Tibbals Lake Park; Volume
2 page 3, records of Jefferson County
be and the same are hereby vacated and abandoned; and
BE IT FURTHER RESOLVED, that said petition was submitted prior to
the adoption of Ordinance No. 2 -76, establishing procedures for the vacation
of County Roads and providing for compensation to the County for such
vacation, and is therefore exempt from said compensation requirements,
except for the cost of publication for hearing.
