HomeMy WebLinkAbout033 73 RESOLUTION NO. 33- 73 "-: " A RESOLUTION OF THE BOARD OF COMMISSIONERS, JEFFERSON COUNTY, WASHINGTON, CREATING A COUNTY PLANNING DEPARTMENT, AND RE-ORGANIZING THE EXISTING COUNTY PLANNING COMMISSION FOR JEFFERSON COUNTY, WASHINGTON, PUR- SUANT TO THE PROVISIONS OF R.C.W. 36.70; AND PRESCRIBING THE POWERS AND DUTIES OF THE PLANNING DEPARTMENT AND OF THE ADVISORY PLANNING COMMISSION AND PRESCRIBING THE NUMBER OF MEMBERS OF THE ADVISORY PLANNING COMMISSION AND SETTING FORTH THEIR TERMS OF OFFICE. WHEREAS, it is the desire of the Board of Commissioners, Jefferson County, Washington, to establish a County Planning Department and County Planning Commis- sion under the provisions of R.C.W. 36.70.010 et seq; NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners, Jefferson County, Washington, as follows: SECTION 1. PLANNING DEPARTMENT ESTABLISHED UNDER R.C. W. 36.70. The Board of Jefferson County Commissioners does hereby elect to operate under the provisions of R.C.W. 36.70.010 et seq. In addition, the Board of Jefferson County Commissioners selects the provisions of R.C.W. 36.70.040 and does hereby create a Planning Department which shall be organized and function as any other department of the county. SECTION 2. PLANNING COMMISSION RE-ORGANIZED. The Board of County Commissioners, pursuant to the provisions of R.C.vV.36.70. 040 does hereby also re-organize the existing planning commission, consisting of 'nine (9) members, which shall assist the planning department in carrying out its duties, in- eluding assistance in the preparation and execution of a county zoning ordinance, periodic up-dating of the Comprehensive Plan, and make recommendations to the department for the adoption of official controls and/or amendments thereto. SECTION 3. PLANNING COMMISSION CONDUCTS HEARINGS. The Planning Commission shall conduct such hearings as are required by R.C. W. 36.70.010 et seq to and including R.C.W. 36.70.960 and shall make findings of fact and conclusions therefrom which shall be transmitted to the Planning Department which shall transmit the same to the Board of Commissioners with such comments and recom- mendations as it deems necessary. SECTION 4. POWERS AND DUTIES. The powers and duties of the Planning Department and of the Planning Commission shall be such as are now described by R.C.W. 36.70.010 et seq and other applicable laws of the State of Washington. When directed to do so by the Board of Jefferson County Commissioners, the County Planning Department and the County Planning Commission shall also perform such other duties as are not inconsistent w tth state law. SECTION 5. ADMINISTRATIVE RESPONSIBILITY. A director of planning shall be appointed by the Board of County Commissioners. He shall be responsible for the proper operation of the planning department; he shall be directly responsible to the Board of County Commissioners; he shall have the responsi- bili'ty of supervising the personnel of the planning staff; and he shall be responsible for providing technical assistance to the planning commission. SECTION 6. FINANCING - PLANNING. The County Planning Department shall incur no financial obligations nor authorize any financial expenditures except for such purposes as are expressly authorized in ad- vance by the Board of County Commissioners in such manner as the law provides. The County Planning Commission shall be subject to the same limitations pertaining to fi- nancial obligations or expenditures. Appropriations for the operation of both the planning department and the planning commission shall be separately identified, but the office 2 accounting or other office records of finances shall be kept by the planning department. SECTION 7. RULES. The Planning Director shall establish such rules and procedures as are necessary to assure thorough and expeditious dealing with matters properly the concern of the plan- ning department except that such procedure shall not be in contravention of State Law or County Resolutions. The Planning Commission shall adopt its own rules and regulations governing the conducting of its internal affairs provided that such rules and regulations shall not be in conflict with State Law or County Resolutions. SECTION 8. APPOINTMENTS. Members of the Planning Commission shall be appointed by the Board of County Commissioners, and as nearly as is mathematically possible, each commissioner district shall be equally represented on the planning commiss ion. SECTION 9. STAGGERED TERMS. To assure staggered terms of office for members of said planning commission as set forth in R.C.W. 36.70.070, .080, .090 and .100, of the nine persons appointed members of the planning commission, initially two (2) shall be appointed for a term of one (1) year; two (2) shall be appointed for a term of two (2) years; two (2) shall be appointed for a term of three (3) years, and three (3) shall be appointed for a term of four (4) years. Thereafter each member appointed to the planning commission shall be (except when appointed to fill a vacancy) for a term of four (4) years. The initial appointments to the planning commission shall be made effective the 1st. day of September, 1973. Thereafter each four-year term shall commence on the 1st. day of September of the year when the term created herein shall exptre and the four-year anniversary thereof. 3 SECTION 10. VACANCIES. Vacancies resulting from the expiration of terms of office shall be filled by appointments for a term of four (4) years. Vacancies occurring for any reason other than the expiration of a term of office shall be by appointment for the unexpired term of the office being filled. SECTION 11. ORGANIZATION. At its first meeting in September, 1973, the planning commission shall organize by electing a chairman and vice-chairman to serve until September, 1974. Thereafter, at the regular meeting in September of each year, the planning commission shall organ- ize by electing a chairman and a vice-chairman to serve for a period of one (1) year beginning as of September of the same year. The planning commission may appoint standing or special committees to each of which it may assign specific responsibilities and authority provided only that such committee shall make no recommendations except to the planning commis s ion. SECTION 12. QUORUM - MEETINGS. Five members of the planning commission shall constitute a quorum. All actions of the planning commission shall be determined by a majority vote at a meeting of which a quorum is present. APPROVED and ADOPTED this /:ftf day of August, 1973. .
