HomeMy WebLinkAbout046 73 !.' l 1 1 ....-- --c RESOLUTION NO. ~-7..5 WHEREAS, it appears to the Board of County Commissioners that it is in the public interest that a formal contract be entered into by and between Jefferson County, a municipal corporation, and Bayshore Enterprises, Inc., a Washington cor- poration, to the end that Chapter III of the Laws of 1967, Extraordinary Session, known as the Community Mental Health Services Act, and the rules and regulations promulgated and adopted by the Director of Social and Health Services of the State of Washington, be implemented and administered in manner and form as contemplated under the aforesaid statute and rules and regulations, and WHEREAS, Chapter 275-12, Washington Administrative Code, authorizes a Board of County Commissioners to contract r P;;;.,kft; or] for mental ae&l~ services in accordance with the foregoing authority, and WHEREAS, a delay will entail in the casting of suitable language to meet the objectives of the proposed contract, and WHEREAS, said Bayshore Enterprises, Inc. presently needs disbursable funds in the amount of $1,700.00 to meet current ob~igations incurred under Jefferson County's responsibility, therefore BE IT RESOLVED that upon the approval of a proper voucher upon the Mental Health and Mental Retardation Fund, the County Auditor for Jefferson County be, and she is hereby authorized -1- ..,. - - .' and empowered to draw her warrant payable to said Bayshore Enterprises, Inc. for the said sum of $1,700.00. I if. .WHEREAS, it is considered in' the best interest of the parties hereto and in the. public welfare to contract for certain community mental health services, now, u~erefore J IT IS MUTUALLY AGREED AND UNDERSTOOD: 1. That the contractor J under the provisions of tbe Community Mental Health Services Act and the roles and regulations in implementation thereof, . agrees to admInister and to provide mental health services within the Counties on an annual basis to t..l}e general extent enumerated in S 7 of this agreement, and provided ~hat the Counties have sufficient funds for this purpose each year. ft211 ~., !- .~--~~~"- .'~~<.:::.:~';.' ..'."'.""'"'-'.:.;........;.. c:+. c. _~.,- 2. That, for the purposes of providing local mental health services within t~ counties for the year 1973, Thurston County will pay the Contrac~or the sum of $15,061.03 derived from taxes, if collected; Mason County will pay the sum of $5, 574.20 derived from taxes, if collected, for a total of $20, 635.23. Provided, that the operating budget for. the year 1973 shall be '$16, llO. 00. The remaining projected revenue over and above ~16, 110.00 shall be used to pay for planning coordinating services of the planning office. Provided, further, that the use of such funds shall be subject.to review by the counties at the end of the year. 3. That counnesshanmake"speedy application to the. WashiiIgton Depatttne'~ .' of Social & Health Services ,for 'allocations and grants-in-aid to promote the mental. health program and the Community Drug Program for reimbursable expenditures only. , 4. It is further agreedthat &oydeficit created by tax delinquency payments. as it pertains to the millage shall not be made up by Counties and it is further understood and agreed thatq~ntractortsaccountand budget shall b~ charged the cost of interest-bearing warrants. .\,. 5. It is further agreed that the Contractor shall deposit all monies derived from public or private sources of all kinds with the Treasurer of Thurston County as fiscal . of!icer of the Counties. Except d1a4 funds contributed by individuals and organizations. to the Community Drug Program for special projects may be held in an earmarked account by the Community Mental Health Center and shall be reported and accounted for apart from the regular operating budget. . 6. The Contractor agrees to use said funds for the administration of, and to provide the mental health services enumerated in Section 7 for the year 1973 beginning on the 1st day of January, 1973. 7. The program of local mental health services within budgetary limits shall consist of: A. Diagnostic and treatment services for those persons in need of mental health services . B. Psychiatric .services for those persons in need of mental health services unable to obtain private care, in cooperation with the contractor'.s existing mental health program. C. Informational services to the general public and educational services furnished by qualified personnel to schools, courts, health and welfare agencies and other appropriate public,or private agencies or groups. D. F . In addition to the above services the Community Mental Health Center will manage a Community Drug Program as an independent project to be accounted for through a separate operating budget. The Community Drug Program services within budgetary limits · shall consist of: (3) Direct services to people with drug related problems ' , Outreach and coordinating services to all community drug agencies presently concerned with the use/ab1se of dtugs Provision of training programs for people who wish to fm- 'prove their personal sldlls and 1:0 increase their abilities for working in the area of drug use/abuse. (1) (2) 8. The County Treasurer will consider the Community Mental Health Center andJ:he Community Drug Program budgets non-lapsing budgets; funds remaining in the Mental Health Center account at the end of a budgetary year (fiscal or calendar) will stay i~ that fund and not revert to the County General Fn!1(LNo ,County .funds shall he spent for' the Community Drng Program which are not reimbursable by the State. . 9. In performance of its duties under this contract, the Contractor shall , submit annually to County Commissioners a report of the activities of its .community mental health services, including a financial accOunting of its expenditures and shall, in addition, if funds are available from the Counties, and if the program is to be continued, submit annually to the County Commissioners for approval a plan of proposed expendittires for succeeding years. 10. It is agreed that the Contractor. shall be paid for its services by vouchers submitted to the auditors of Thurston and Mason counties. who are the auditing officers of the Counties, and who will issue warrants in payment . of claims. The Coonty Treasurer is the custodian of funds and shall redeem such warrants from funds available by appropriation. 12. That failure of the Contractor to comply with the terms of this agree- ment shall give the Counties the right to withhold payment of any further funds under this agreemertt. , 13. That the Contractor agrees to observe all the provisions of the C~- nity Mental Health Services Act and the roles and regulations promulgated and adopted in implementation thereof. The parties hereto specifically agree that no . . person shall, on the groonds of race, creed, color or national origin be excluded from.full employment rights in, participation in, be denied' the benefits of, or be otherwise subjected to discrimination under any program, service or activity for willen L'1e parties have received, or will receive financial assistance under the pro- visions of the act and thesE; roles and regulations; in addition, the parties hereto specifically agree to observe the federal and state laws against discrimination, and in particular, Chapter 49. 80 RCW. 14. That the Contractor agrees that the Secretary of the Department of Social and Health Services and the State Auditor may inspect all records and other material which the secretary and the auditor deem pertinent to the contract and its performance; and the Contractor further agrees that such records and material shall be made available to the secretary and the auditor. 15. This agreeme!1t is subject to termina~on at any time by the CwnUes or the Contractor upon thirty (30) days notice given in writing by one to the other, except for default hereof, in which event no notice shall be required. 17. Box 161 Port Townsend Washington 98368 County Corrunissioners Jefferson County Court House Port Towns end, WA 98368 Gentlemen: As you know Bayshore Enterprises Inc. is the recipient of Revenue Sharing funds through your interest and that of the city of Port Townsend. 'The county auditor is supervising these monies through your standard voucher procedure. 'This method is particularly awkward for us at this time since we do not have enough cash flow to meet our payroll of next month and our petty cash needs. 'The board of directors for Bayshore Enterprises passed a resolution at their last scheduled meeting that I request than an adequate sum from our funds in the county MH-MR. fund be assigned to our bank account for the purposes mentioned above. We will have a monthly payroll of $1500 plus some cash purchases so a figure of $1700.00 would be adequat'e. We would continue to voucher those items which are paid f6r through local charge accounts.
