Superior Court Cases Filed Under
Title 26 RCW (Excluding RCW 26.50 Et Seq),
To Increase Funding For The
Courthouse Facilitator Program
ORDINANCE NO. 07 Q711 05
WHEREAS, RCW 26.12.240 authorized counties to create a Courthouse Facilitator
Program to provide basic services to pro se litigants in family law cases and Jefferson County Ordinance
Number 01-0226-01 provided for such a program in Jefferson County; and,
WHEREAS, RCW 26.12.240 further authorizes the County legislative authority to impose
user fees or surcharge or both on only Superior Court cases filed under Title 26 RCW to pay for the
expenses of the Courthouse Facilitator Program; and,
WHEREAS, the Washington Legislature has previously found that domestic violence is at
the core of major social problems and has established a reduced statutory filing fee for domestic violence
cases filed under RCW 26.50 et seq; and,
WHEREAS, the 2004 legislature passed, and on May 13,2005 the Governor signed
Engrossed Substitute House Bill 1314, which increases the surcharge for the Courthouse Facilitator Program
and also provides fees for the Domestic Violence Prevention Account and local service programs, which
fees go into effect on July 24, 2005,
NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of
Jefferson County that ORDINANCE NO. 01-0226-01 is hereby amended to include the following changes
and/or additions to the following sections:
Section One: Purpose The purpose of this ordinance is to authorize the Clerk of the Superior Court of
Jefferson County to assess an additional ten dollar ($10.00) surcharge on certain Superior Court cases filed
under Title 26 RCW for the purpose of paying the expenses of the Court Facilitator Program. A new thirty
dollar ($30.00) surcharge will also be added to all initial divorce, separation, and invalidity of marriage
petitions. This surcharge will go into the State's Domestic Violence Prevention Account, local domestic
violence related service progra!Rs.,,)~!ld up to 5% into local court administration costs, as stipulated in revised
