HomeMy WebLinkAbout01 0103 06(�C: �I-R (A 11(4 � STATE OF WASHINGTON County of Jefferson In the Matter of an Ordinance to Allow } Disbursement of Conservation Futures } Monies for Operation and Maintenance } ORDINANCE NO. 01-0103-06 of Interests in Real Property (Amends } Ordinance No. 06-0708-02) } WHEREAS, the Washington State legislature has provided for the acquisition of open space land pursuant to Title 84.34 RCW; and, WHEREAS, Jefferson County has identified preservation of open space as important to and for County residents; and, WHEREAS, the preservation and enhancement of existing open space lands is a stated goal of the County's 1998 Comprehensive Plan; and, WHEREAS, the 59th Legislature passed Engrossed Substitute House Bill 1631 relating to using revenues under the county conservation futures levy; and amending RCW 84.24.320 and 84.34.240 effective July 24, 2005; and WHEREAS, the approved disbursements for operation and maintenance of interests in real property purchased with conservation futures tax levy monies shall not exceed in any particular year fifteen percent (15%) of the conservation futures levy monies raised in the preceding year, WHEREAS, funds appropriated for operation and maintenance of interests in real property may not supplant or replace any existing funding for maintenance and operation of parks and recreational lands, NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Jefferson County, Washington, that Ordinance #06-0708-02 be amended as follows: Section 1 The first sentence of Section 7 shall read as follows, "The disbursement requests shall be made for capital projects (purchases of interests in real property) or for operation and maintenance of interests in real property purchased with conservation futures tax levy monies." The second sentence of Section 7 shall read as follows, "Capital project expenditures shall be deemed to include all costs of acquiring real property, including interests in real property, and the following costs: the cost of related relocation of eligible occupants, cost of appraisal, cost of appraisal review, cost of title insurance, closing costs, pro rata real estate taxes, recording fees, compensating tax, hazardous waste substances reports, directly related staff costs and related legal and administrative costs, but shall not include the cost of preparing applications for conservation futures funds." Ordinance No. 01-0103-06 re: Amendments to Conservation Futures Ordinance The third sentence of Section 7 shall read as follows, "Directly related staff costs shall not exceed five percent (5%) of the total cost of the project." A sentence is added to page 8 after the 3rd sentence of Section 7. The new sentence shall read as follows, "Approved disbursements for operation and maintenance of interests in real property purchased with conservation futures tax levy monies shall not exceed in any particular year fifteen percent (15%) of the conservation futures tax levy monies raised in the preceding year." A second sentence is added to page 8 after the 3rd sentence of Section 7. The new sentence shall read as follows, "Operation and maintenance funding may be used for any property acquired with Conservation Futures funds." A sentence is added to page 8 after the 4th original sentence of Section 7. The new sentence shall read as follows, "Conservation futures tax levy funds appropriated for operation and maintenance of interests in real property shall not supplant or replace any existing funding for maintenance and operation of parks and recreational lands." Section 2 All other portions of the Ordinance #06-0708-02 remain valid and in effect.
