WHEREAS, The United States has made available funds for a project

hereof; and
WHEREAS, In accordance with the provisions of the Flood Control Act,
approved 22 June 1936, as amended (33 USGSection 7016), and pertinent
administrative determinations such funds cannot be used until a respon-
sible local agency has gi'ven'assurances satisfactory to the Secretary of
the Army that it will:

a. Furnish without cost to the United States all lands, easements,

rights-of-way, and rights-of-entry, and perform all necessary altera-

tions to utilities;
b. Hold the United States free from any. claims fo~ dama,ge~ liri,sing
out of the construction;
c. Maintain and operate the project works, after construction;
