C!.. - 'I (j 0 'WHEREAS, the property and equipment of what is now known as the Jefferson County Airport, formerly a part of the Fort Townsend Military Reservation, which was acquired by Jefferson County from the United States of America, acting by and through its War Assets Administrator, and by virtue of the laws, powers, regulations and legal de- scription imposed in certain documents, recorded in the office of the County Auditor of Jefferson County, to-wit: Resolution No. C-2, adopted by the Board of County Commis- sioners for Jefferson County, January 19, 1947, and recorded in Volume N at page 21 of County Commissioners' Proceedings; Quit-claim deed from the United States of America to Jef- ferson County, filed for record February 5, 1947, receiv- ing No. 109412, and recorded in Volume 120 of deeds on page 120 et seq, records of said county, and, vlliEREAS, it has been the consensus of those inter- ested in air transportation development, that the said airport property could, due to flexibility of the Washing- ton statutes insofar as they pertain to port aistr~c~s, be better operated as an airport facility by the Port of Port Townsend; and, iffiEREAS, this Board of County Commissioners has been informed that said Port of Port Townsend is desirous " of acquiring said airport facility, and, VffiEREAS, said Port of Port Townsend is a municipal corporation and authorized inter alia, to operate airports, and that a lawful and adequate consideration for the trans- fer of the airport from Jefferson County to the Port of Port Townsend, would be the promises and agreement of the ~""-" " "<!t.l.; 1 -' i -, ~ __e -- . .. 1 Port of Port Townsend to operate the same as a service to 2 all the people of the county, and others, and as an aid 3 to t he economic activity and development of Jefferson 4 County, and to assume all the duties and obligations here- 5 tofore imposed on Jefferson County by the several documents 6 hereinabove referred to, and 7 ~VHEREAS, it further appearing that said Port of 8 Port Townsend by law has greater means and ability t~ 9 operate and maintain said airport to its maximum capacity, 10 and, 11 :ffiEREAS, the Port of Port Townsend has agreed to ~ accept a transfer of the property involved, and this Board 13 of County Commissioners deems that it is in the public 14 innerest, and to the benefit 'of the community at large, 15 and to others, that said Port of Port Townsend acquire H said airport and operate and maintain the same, now, U therefore, 18 BE IT RESOLVED by the Board of County Commissioners 19 of Jefferson County, in consideration of the agreement by 20 the Port of Port Townsend to operate and maintain said 21 Jefferson County airport, and its facilities, and equip- ~ ment, for the use and benefit of the public, and to assume 23 the duties, burdens, covenants and conditions imposed by ~ the several documents as herein noted, this said Board 25 does now and hereby authorize and direct the execution of ~ a quit-claim deed of conveyance by Jefferson County to the 27 Port of Port Townsend, a municipal corporation, of all of ~ said airport property as reflected in the deed from the ~ United States of America to Jefferson County, dated Janu- 30 ary 19) 1947, as aforesaid; and said deed having been pre- 31 pared and executed by the Board of County Commissioners 4 #J>.. ,... ... 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 .. . -e- . .. . ....,. .e 1 for Jefferson County, simultaneously with the adoption of 2 this resolution, the same shall be irrevocable from date of delivery, subject, however: (1) That the Administrator of Civil Aeronautics shall a pprove the transfer of s aid airport, and its opera- tion and maintenance, by the Port of Port To.wnsend; (2) That the Port of Port Townsend shall, pursuant to its statutory processes and powers, lawfully and pro- perly accept said property and assume the duties, burdens, covenants and conditions as set forth under Resolution No. C-2 of the Board of County Commissioners of Jefferson County, as aforesaid, and said quit-claim deed from the United States of America to Jefferson County, dated Janu- ary 19, 1947; (3) That upon approval of the Administrator of Civil Aeronautics and the acceptance thereof by the Port of Port TO\Vllsend, possession of said property, and the whole there- of, and the operation and maintenance of said airport shall be transferred to the Port of Port Townsend on the first day of the month following said acceptance and approval.
