HILLER AND OTHERS FOR ) VACA.TION OF A COUNTY ROAD KNOWN ) &S '!'HE OAK BAY-B'1'TS MATTS ROAD, ) :jj,. e - j+ RESOLUTION VACATING PORTION OF COUlTY ROAD The petition of W.. Hiller and others for vacation and abandonment of the portioD of the county road hereinatter described came on regularly tor hearing betore the Board of County ColUll1s8ioners at Jettersoa County on the I ~ day of ~ 194", at /d~t:;oblc1ock ~ M. The report of the County Engineer on the petition having been duly filed and oOBsldered by the Board and proof of service and publication of notice of the ti.e and place at the hearing having beendu17 filed and the Board having heard all persons desiring to be heard tor or against the granting of the petition and having considered the report at the County Engineer thereon together with all evidence for aDd objection against such vacation or abandonment, the Board, being tully advised, finds: 1. That the petition for vacation was signed by more than ten freeholders residing in the vicinity ot the por- tion ot the county proposed to be vacated and conforas to the requirements of law in all resp&cts. 2. That notice of the t1me aDd place of hearing the petition was published and posted as required b1 law. 3. That at the ti_ of .filing the petition, petition- er Wm. Hiller deposited with Jefferson County $100.00 in cash in lieu of a bond conditioned that the petitioners will pay into the County road tund the amount of all costsand expenses In- ourred in the examinatlon, report, and all proceedings per- taining to such petition to vaoate and abandon. 4. That the portion of count,. road desoribed in the petition is not usetul and the public will be benefitted by its vacatlon. 5. That all costs and expenses incurred In the pro- ceedings have been paid out ot the $100.00 deposit above men- tioned. It Is theretore RESOLVED that the portion ot the above named /oounty road described as follows: All that portlon of abandoned County Road No. 180 lying in Gov. Lot 3, See. 7, Township 29 North, Range 1 E.W.M. Is hereb,. declared to be vaoa'bed. and abandoned and that such vacation and abandonment be entered in the minuss of th1s Board.
