MINUTES
Week of January 23,2006
Chairman Phil Johnson and Commissioner Patrick M. Rodgers were absent due to illness.
As a result, there was not a quorum of the Board. The meeting was postponed until Thursday, January 26,
2006 at 2 p.m. in order for the Board to deal with agenda items that needed to be approved in a timely
manner.
Chairman Phil Johnson called the meeting to order in the presence of Commissioner David
Sullivan. Commissioner Patrick M. Rodgers was absent due to an excused absence.
APPROVAL AND ADOPTION OF THE CONSENT AGENDA: Commissioner Sullivan
moved to approve all ofthe items on the Consent Agenda. Chairman Johnson seconded the motion which
carried.

Proposed Ordinance Adopting Amendments to the Unified Development Code: Assistant
Planner Kyle Aim explained that the proposed ordinance amends Jefferson County Code Chapter 18.45
(Comprehensive Plan & GMA Implementing Regulations Amendment Process) to change the deadline for
submission of Comprehensive Plan amendments from February 1 to March 1, Chapter 18.50 (Enforcement),
and adds a disclaimer to Chapter 18.18 (Irondale and Port Hadlock UGA Development Regulation
Implementation) .
Commissioner Sullivan stated that removing Chapter 18.18 was an option that had been mentioned but was
downplayed because removing it from the UDC could be challenged. Chairman Johnson stated that his first
thought was to remove the chapter. Commissioner Sullivan asked if adding the disclaimer to Chapter 18.18
could be challenged? County Administrator John Fischbach explained that a great deal of public
participation went into the creation of the regulations in Chapter 18.18. If the Board takes action to remove
the chapter, when the pending Western Washington Growth Management Hearings Board case is settled, the
chapter cannot be replaced in the UDC without the possibility of a challenge to every regulation. Kyle AIm
added that staff would like to see the chapter remain because the Planning Commission is interested in
reviewing it this year. Civil Deputy Prosecuting Attorney David Alvarez explained that adding the
disclaimer was the result of the Final Decision and Order ofWWGMGB which stated that the County can't
use urban development regulations in the UGA unless the Hearings Board or Superior Court approves. The
disclaimer recognizes that the regulations are not in effect until the Hearings Board's final decision. There
was a discussion about the public participation regarding the addition of the disclaimer. David Alvarez
stated that he would argue that this isn't a public policy question, it is about complying with the WWGMHB
order until the County comes into compliance. The disclaimer would need to be removed by ordinance.

Commissioner Sullivan moved to approve ORDINANCE NO. 02-0126-06, adopting amendments to the
Unified Development Code, also known as Chapter 18 of the Jefferson County Code. Chairman Johnson
seconded the motion which carried.
