HomeMy WebLinkAbout025 05 [to -Jiu VtfPJ- '-f-/1 '0S- STATE OF WASHINGTON COUNTY OF JEFFERSON In the Matter of Reimbursement to } Certain County Officials } for Use of Personal Vehicles } RESOLUTION NO. 25-05 WHEREAS, the elected Board of County Commissioners have official duties and responsibilities which require the use of a motor vehicle; and, these duties and responsibilities are such that they require the use of a County owned vehicle or reimbursement to these officials for the use of a personal vehicle; and WHEREAS, the County legislative authority is authorized by RCW 42.24.090 to specify payment of a personal vehicle allowance; and, NOW, THEREFORE, BE IT RESOLVED, by the Board of Jefferson County Commissioners that each County Commissioner are each hereby authorized to make a choice annually during the preliminary budget process for the following year of one of the following methods for their transportation needs in the performance of their official duties: 1) Use a County car designated for their use only. 2) Submit a monthly expense voucher for all miles driven on official County business as provided in the County Travel Policy. 3) Utilize his/her private automobile for all official County business for which an Personal Vehicle Allowance payment will be made per month by a vouchered expense claims warrant. BE IT FURTHER RESOL VED, that the Board of County Commissioners set the Personal Vehicle Allowance to be ninety percent (90%) of the average (mean) monthly rental cost for a mid- size vehicle which is determined by the Central Services Department as part of the preliminary budget process each year. Such percentage is hereby established for each position authorized to receive the Personal Vehicle Allowance. BE IT FURTHER RESOLVED, that prior to receiving an Personal Vehicle Allowance payment, each person authorized to receive such payment shall provide to the County Auditor a Certificate of Automobile Liability Insurance in the minimum amount of $100,000/$300,000. WOJT, DISTRICT 3 March 11, 1996 TO: All Departments FROM: David Goldsmith, Deputy Director of Public Services RE: Use of Private Automobiles for County Business The Washington Counties Risk Pool is tracking a couple of cases where employees were involved in accidents while using private automobiles for public business. This is important issue as the insurance companies are attempting to transfer a portion of the liability to the County for the business use of private vehicles. The mileage reimbursement received by employee is intended to cover the costs for using the vehicle, including associated insurance. I have spoken with a number of local insurance brokers about this issue and gave them a couple of scenarios to evaluate. Here is what the brokers are saymg: Situation 1 : You are regularly driving for business use, do not have business use coverage and you are involved in an accident Most policies will cover your personal exposure (property and bodily injwy liability), although some may have exclusions, so you should check with your agent If the insurance company determines that you are using your vehicle on a regular basis for business use and this has not been reported, the company could at their option cancel or non-renew your policy. To avoid this situation, you should take out business use insurance which, depending on the amount of business related miles, can cost up to 3001<<. of your personal use insurance. Situation 2: You use your vehicle occasionally for business use and do not have business coverage and you are involved in an accident, most likely your policy will cover incidental use (check with your agent). Ifoot, you can work with your agent to make appropriate adjustments to your policy to protect against occasional business use (something greater than personal use and less than business use). The concern of the insurance company is that they are receiving proper premium payment for the exposure they are covering and that the amount of exposure is fully disclosed. There was some speculation that insurance companies would not cover employee personal liability in the event of an accident while using the vehicle for business. It appears this is not the case, although you are well advised to contact your agent to fully understand what your policy contains. They will be happy to review the driving you do for business and advise you accordingly. I"! "., Recycled Paper . . The Pool policy does cover privately-owned automobiles used in the conduct of member County business; however the policy is secondary to the employee's own insurance coverage, but pertains only to third party liability and property <hunage. The policy does not cover the employee, nor the privately-owned vehicle or other property owned by the employee. Once the employee's insurance is exha~.the Poolpolicy would be triggered for covemge. Additionally, the above is subject to the member county's deductible. For example, say a third party was injured and the injury exhausted the employee's insurance covemge. In this instance, the Pool's policy would be initiated and provide covemge less the County's deductible. i While there is no written policy, the Pool does encourage its member counties to ask for adequate covemge for those driving private vehicles on County business. The Pool also encourages that the applicable member county be named as an additional insured for anyone driving on a regular and routine bases, i.e. business use of their private vehicle. Insurance companies generally will not issue an additional insured for personal use of the vehicle; however they routinely do issue an additional insured for the business use of a private vehicle. Examples include insurance agents, real estate agents and the like. By being named an additional insured, the County is further protected in that the insurance company must defend the County against actions arising out of the use of a privately-owned vehicle. They must pay County incurred defense costs, they cannot dismiss their obligation to the County or third party due to bankruptcy of the insured, they cannot subrogate against the County, and they would cover personal injury as well as genera1liability. 360/586-7447 FAX 360/586-7446 Claims: 360/586-7444 FAX 3601586-7443 """_._~._"""--"""""-;---' ~.p;,. .-"";'" I -,. -.- For casual use of a privately-owned vehicle for county business, member counties are encouraged to request and obtain a certificate of insurance, or obtain a copy of the employee's insurance card; thereby providing evidence of coverage and limits.
