In the Matter of Repealing Resolution 36-05 }

About "Formula Stores" }
RESOLUTION NO. 39-05
WHEREAS, the Board of County Commissioners did approve resolution 36-05,
which requested that the City not vote on "formula store" ordinance at a special business
meeting scheduled for Monday, June 13th, at 8:00 pm to be held at the Blue Heron School;
and
WHEREAS, the City Council actually was voting on a resolution to clarify their
findings in their original interim resolution of April 18, 2005; and
WHEREAS, the City Council through the City's Planning Commission will be
providing adequate opportunity for public input, including comments from the County,
during the next several months;
THEREFORE BE IT RESOL VED, that the Board of Commissioners hereby repeals
resolution 36-05 as unnecessary.

Item: Formula Store Resolution
Last night I attended the City Council special business meeting. The purpose of that
meeting was different than we had thought. They did not vote on the final formula store
ordinance, but rather voted on a resolution that clarifies the "findings of fact" in the
interim formula store resolution that was adopted on April 18th. The interim formula
store ordinance has been forwarded to the City Planning Commission for full review and
public input prior to final adoption sometime this Fall.
Since the BOCC's resolution, 36-05, assumed that the City Council was adopting the
final formula store ordinance, I did not give copies of the resolution (see attached) to
City staff or Council and made no public comment.
I will provide a resolution repealing 36-05 for next Monday's meeting on the consent
agenda.
