In the Matter of Continuity }
of County Government in the Case }
of An Emergency or Disaster }
WHEREAS, the uninterrupted continuity of powers and duties of the
Board of County Commissioners and the departments and offices of the County need to
be preserved in time of emergency or disaster as defined by RCW 38.52.010(6)(a); and,
RESOLUTION NO. 54-05
WHEREAS, Chapter 42.14 RCW, the Continuity of Government Act,
provides authority for identification of a succession of powers in an emergency; and,
WHEREAS, ''unavailable'' means the lawful incumbent of the office or
the department head is unable by reason of the emergency to exercise the powers and
discharge the duties of the office or department.
NOW, THEREFORE BE IT RESOL VED, that the following are the
Jefferson County rules for succession of powers and the conduct of business in an
emergency or disaster:
1. In the event that an emergency or disaster reduces the number of available County
Commissioners, then those Commissioners that are available for duty shall have
full authority to act as a Board of County Commissioners.
2. In the event that no County Commissioner is available, then three (3) eligible (see
list) and available Elected Officials shall jointly act as the Board of County
Commissioners, and shall possess by majority vote the full authority of the Board
of County Commissioners regarding the emergency at hand. If more than three
eligible Elected Officials are available to serve as. the Board of County
Commissioners, then the three eligible and available Elected Officials who have
held their current elected office the longest shall constitute the Board of County
Commissioners. Iflength of current incumbency results in more than three
persons being chosen to serve as the Board of County Commissioners, then said
tie shall be resolved so that the younger or youngest elected official or officials
between or among the 'tied' elected officials shall serve. The following are
eligible Elected Officials: Auditor, Assessor, Clerk, District Court Judge,
Prosecuting Attorney, Sheriff and Treasurer.
3. Each department and office of the County shall designate a line of succession for
the discharge of emergency actions in the event that the incumbent office holder
or department head is unavailable.
4. The available responsible person as defined by the designated line of succession
shall have the full authority of the incumbent office holder or department head in
carrying out the emergency actions of the department but shall not be empowered
by this section to serve as a member of the replacement Board of County
Commissioners described in Section 2 above.

5. Whenever it becomes impossible to conduct the affairs of the County at the
regular or usual place, the Board of County Commissioners, and all offices and
departments, may meet at any place provided a reasonable effort is made to notify
the public of the emergency relocation. After any relocation, the affairs of the
County shall be lawfully conducted at such location for the duration of the
emergency.
